【摘要】：主體本質(zhì)上是意志之存在形式。欠缺行為能力人以監(jiān)護(hù)人意志為意志。擬制主體以法定代表人職務(wù)行為意志為意志。法律定分止?fàn)幹m用范圍限于法律主體,本質(zhì)上限于意志。所謂人格、主體資格、權(quán)利能力,均以意志為其充要條件和唯一根據(jù)。權(quán)利能力存續(xù)期間即意志存續(xù)期間,就現(xiàn)代人而言,只能始于出生,終于死亡。民法之利益即歸屬之財(cái)產(chǎn),歸屬者即法律主體。如胎兒有自己的利益,即為主體,但在很多情況下,法律將無(wú)法區(qū)分歸屬胎兒的行為后果與歸屬其母親的行為后果,喪失定分止?fàn)幑δ?監(jiān)護(hù)制度不適用于胎兒。遺產(chǎn)分割時(shí)保留胎兒的預(yù)留份額,是使胎兒活產(chǎn)后與其他繼承人享有平等繼承資格。保護(hù)胎兒在法理上是保護(hù)胎兒出生后的權(quán)利。
[Abstract]:The subject is essentially a form of will. The incapacitated person takes the will of the guardian as his will. The fictitious subject acts with the will of the legal representative. The scope of application of the legal division dispute is limited to the subject of law and, in essence, to will. So-called personality, subject qualification, right ability, all take will as its sufficient and necessary condition and sole basis. As far as modern people are concerned, the existence of power and ability, that is, the period of will, can only begin with birth and finally die. The interest of civil law is the property to which it belongs, and the ascription is the subject of law. If the fetus has its own interests, that is, as the subject, but in many cases, the law will not be able to distinguish the consequences of the behavior belonging to the fetus from the consequences of the act of belonging to its mother, and lose the function of dividing the fetus and ending the dispute, and the guardianship system will not be applicable to the fetus. To keep the reserved share of the fetus in the division of the estate is to make the fetal live postpartum equal with the other heirs. To protect the fetus is to protect the right of the fetus after birth.
