【摘要】：《合同法》第2條界定了合同的概念,規(guī)定了該法的適用范圍,但對(duì)于該條規(guī)定的"民事權(quán)利義務(wù)關(guān)系"存在不同解釋,而不同解釋直接影響到《合同法》的適用范圍。文章首先從解釋方法的選擇和適用入手,認(rèn)為應(yīng)當(dāng)堅(jiān)持文義解釋優(yōu)先�；谶@種解釋,《合同法》第2條所規(guī)定的合同變更的"民事權(quán)利義務(wù)關(guān)系",包括但不限于債權(quán)關(guān)系,除債權(quán)關(guān)系外,還包括物權(quán)關(guān)系和身份關(guān)系。如果解釋《合同法》第2條采廣義合同說,民法典總則就應(yīng)當(dāng)規(guī)定合同的一般規(guī)則。
[Abstract]:Article 2 of contract Law defines the concept of contract and defines the scope of application of the law. However, there are different interpretations of the "relationship between civil rights and obligations" stipulated in this article, and different interpretations directly affect the scope of application of contract Law. The article starts with the choice and application of interpretation methods, and thinks that literary meaning interpretation should be preferred. Based on this interpretation, the "relationship of civil rights and obligations" stipulated in Article 2 of the contract Law includes, but is not limited to, the relationship of creditor's rights, including the relationship of real right and identity, in addition to the relation of creditor's rights. If article 2 of contract Law is interpreted as broad contract, the general rules of civil code should be stipulated.
