【摘要】：誠實(shí)信用原則是我國民法的一項(xiàng)基本原則,是建立平等、和諧、文明、有序的社會(huì)環(huán)境的一項(xiàng)最基本的行為準(zhǔn)則,誠實(shí)信用原則具有道德性規(guī)范和法律性規(guī)范的雙重性質(zhì),是道德準(zhǔn)則法律化的典型代表,對(duì)監(jiān)督和制約民事法律活動(dòng)主體的行為有著深層次的意義,被譽(yù)為“帝王條款”。在最近的民法典編纂過程中,明確將誠信原則與平等原則、自愿原則、公平原則、守法原則和綠色原則等共同確立為《民法總則》的基本原則。誠實(shí)信用原則在民法實(shí)體法和程序法中均有適用,文章著重從實(shí)體法的角度闡述誠信原則的法律適用問題。首先是對(duì)誠實(shí)信用原則一般理論的介紹,闡述了誠信原則的內(nèi)涵、特征和功能,為后面的論述作好理論鋪墊;其次論述了誠實(shí)信用原則在我國民法中的適用情況,在《民法總則》、《物權(quán)法》、債權(quán)法、《侵權(quán)責(zé)任法》等中的體現(xiàn),以及誠實(shí)信用原則在兩大法系中的發(fā)展過程和適用情況,與實(shí)際案例相結(jié)合,進(jìn)行橫向比較和縱向分析。最后通過對(duì)上述內(nèi)容的探討,總結(jié)出誠實(shí)信用原則在我國民法適用中存在的問題和原因,并提出可行性建議。文章力求通過對(duì)我國民法中誠實(shí)信用原則的分析和探究,使誠實(shí)信用原則在我國民事立法中更加完善,使誠實(shí)信用原則的功能和作用隨著經(jīng)濟(jì)社會(huì)的發(fā)展發(fā)揮其更大的作用,以促進(jìn)和推動(dòng)我國社會(huì)主義市場經(jīng)濟(jì)健康、有序、快速發(fā)展,促進(jìn)和推動(dòng)社會(huì)主義和諧社會(huì)的建設(shè)。
[Abstract]:The principle of good faith is one of the basic principles of civil law in China, and the most basic code of conduct for the establishment of an equal, harmonious, civilized and orderly social environment. The principle of good faith has the dual nature of moral norms and legal norms. It is a typical representative of the legalization of moral norms, which has a deep meaning to supervise and restrict the behavior of the subject of civil legal activities, and is praised as the "monarch clause". In the recent civil code compilation process, the principle of good faith and equality, the principle of voluntary, the principle of fairness, the principle of abiding by the law and the principle of green are clearly established as the basic principles of the General principles of Civil Law. The principle of good faith is applicable in both civil law and procedural law. This paper focuses on the legal application of the principle of good faith from the point of view of substantive law. First of all, it introduces the general theory of the principle of good faith, expounds the connotation, characteristics and functions of the principle of good faith, and lays a good foundation for the later discussion, and then discusses the application of the principle of good faith in the civil law of our country. In "General principles of Civil Law", "property Law", "creditor's Rights Law", "Tort liability Law" and so on, as well as the development process and application of the principle of good faith in the two legal systems, combining with the actual cases, the horizontal comparison and longitudinal analysis are carried out. Finally, through the above content discussion, summarizes the good faith principle in our country civil law application existence question and the reason, and puts forward the feasibility suggestion. Through the analysis and exploration of the principle of good faith in the civil law of our country, the article tries to make the principle of good faith more perfect in the civil legislation of our country, and make the function and function of the principle of good faith play a greater role with the development of economy and society. In order to promote and promote the healthy, orderly and rapid development of China's socialist market economy, promote and promote the construction of a harmonious socialist society.
