【摘要】:隨著市場(chǎng)經(jīng)濟(jì)的不斷發(fā)展,競(jìng)爭(zhēng)愈演愈烈,為了提高商品的市場(chǎng)知名度,刺激消費(fèi)者的購(gòu)買欲望,越來(lái)越多的經(jīng)營(yíng)者開(kāi)始利用知名形象,將知名形象與其商品用各種方式聯(lián)系起來(lái),以此帶來(lái)巨額的商業(yè)利潤(rùn)。于是在現(xiàn)代社會(huì)中,商品化權(quán)漸漸引起人們的廣泛關(guān)注。國(guó)外關(guān)于商品化權(quán)的研究和立法要領(lǐng)先我們很多,我國(guó)對(duì)商品化及商品化權(quán)的研究還處于初級(jí)階段。目前學(xué)界有不少學(xué)者已經(jīng)對(duì)該問(wèn)題進(jìn)行了相關(guān)的理論研究,并取得了不錯(cuò)的成果,但是對(duì)商品化權(quán)的探討都不夠深入,沒(méi)法形成系統(tǒng)的體系。與此同時(shí),司法實(shí)踐中關(guān)于商品化權(quán)的案例已經(jīng)存在,而立法上的缺陷使的權(quán)利人無(wú)法準(zhǔn)確表達(dá)自己的訴求,法官們也對(duì)法律適用感到困難重重,無(wú)法有效的解決此類糾紛。長(zhǎng)此以往,將會(huì)引發(fā)越來(lái)越多的社會(huì)矛盾,我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)的有序發(fā)展也會(huì)受到阻礙。鑒于此,筆者大膽的通過(guò)此文探析商品化權(quán)的法律關(guān)系,其法律制度的構(gòu)建,以及當(dāng)前環(huán)境下如何保護(hù)公民的權(quán)利。通過(guò)法律制度的構(gòu)建,充分發(fā)揮法律的規(guī)范作用和社會(huì)作用,對(duì)關(guān)乎商品化權(quán)的社會(huì)矛盾與糾紛給予有效的法律規(guī)制,從而為我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)的發(fā)展提供有力法律保障。本文大體上分為五個(gè)部分:第一部分為引言,敘述了商品化權(quán)的研究背景和意義、國(guó)內(nèi)外目前對(duì)商品化權(quán)的研究情況、本文的主要研究方法、文章的創(chuàng)新點(diǎn)及缺點(diǎn)。第二部分對(duì)形象、知名形象、商品化、商品化權(quán)做了論述并在此基礎(chǔ)上對(duì)知名人物商品化權(quán)的內(nèi)容和法律關(guān)系做了進(jìn)一步論述。第三部分從幾個(gè)案例出發(fā)引出了目前國(guó)內(nèi)存在的問(wèn)題,而現(xiàn)行法律的相關(guān)規(guī)定無(wú)法有效解決這些問(wèn)題,突顯了知名形象法律保護(hù)的必要性和緊迫性。第四部分?jǐn)⑹隽酥蜗笊唐坊瘷?quán)在大陸法系和英美法系國(guó)家的發(fā)展背景和立法保護(hù)現(xiàn)狀及借鑒。第五部分?jǐn)⑹隽宋覈?guó)如何創(chuàng)設(shè)商品化權(quán),如何認(rèn)定侵犯知名形象商品化的行為和如何進(jìn)行法律救濟(jì)。
[Abstract]:With the continuous development of market economy and the intensification of competition, in order to improve the market awareness of commodities and stimulate consumers' desire to buy, more and more operators have begun to make use of the well-known image. Connect the famous image with its goods in various ways, thus bringing huge commercial profits. Therefore, in the modern society, the right to commercialize gradually aroused widespread concern. Foreign research and legislation on the right to commercialize is much ahead of us, and the research on the right to commercialize and commercialize in our country is still in the primary stage. At present, many scholars have carried on the related theory research to this question, and obtained the good result, but the discussion to the commercialization right is not deep enough, cannot form the systematic system. At the same time, the case of the right of commercialization has already existed in the judicial practice, and the defects in the legislation make the obligee unable to express his demands accurately, and the judges also feel that the application of the law is very difficult, and they cannot effectively resolve this kind of dispute. In the long run, more and more social contradictions will arise, and the orderly development of our socialist market economy will be hindered. In view of this, the author boldly analyzes the legal relationship of commercialization right, the construction of its legal system, and how to protect the rights of citizens under the current environment. Through the construction of the legal system, we can give full play to the normative and social functions of the law, and give effective legal regulation to the social contradictions and disputes related to the right of commercialization, thus providing a strong legal guarantee for the development of our socialist market economy. This paper is divided into five parts: the first part is the introduction, describing the research background and significance of the commercial right, the current research situation of the commercial right at home and abroad, the main research methods of this paper, the innovation points and shortcomings of the article. The second part discusses the content and legal relationship of the right of commercialization of famous characters. The third part leads to the problems existing in our country from several cases, but the relevant provisions of the current law can not effectively solve these problems, which highlights the necessity and urgency of the legal protection of well-known image. The fourth part describes the development background and legislative protection of the right of commercialization of well-known image in the countries of civil law system and common law system. The fifth part describes how to establish the right of commercialization, how to determine the behavior of commoditization of the well-known image and how to carry out legal remedies.
