【摘要】：大數(shù)據(jù)交易平臺的建立讓信息不再是一座座孤島。然而我國大數(shù)據(jù)交易尚處于起步階段,在相關(guān)法律政策缺失的情況下,大數(shù)據(jù)交易面臨著巨大的產(chǎn)權(quán)風(fēng)險。文章在調(diào)查國內(nèi)外大數(shù)據(jù)交易的法律政策與實踐現(xiàn)狀基礎(chǔ)上,對交易過程中涉及的授權(quán)合法性、交易安全、交易成本、交易公平、隱私保護等產(chǎn)權(quán)問題進行了分析,為我國的大數(shù)據(jù)交易從法律政策的制定、行業(yè)法規(guī)的建立、產(chǎn)權(quán)環(huán)境的改善等方面提出建議。
[Abstract]:The establishment of big data trading platform makes information no longer a lonely island. However, the big data transaction in China is still in its infancy. In the absence of relevant laws and policies, the big data transaction faces a huge risk of property rights. On the basis of investigating the legal policy and practice of big data transaction at home and abroad, this paper analyzes the property rights issues such as authorization legitimacy, transaction security, transaction cost, transaction fairness, privacy protection and so on. Some suggestions are put forward for the big data transaction in China, such as the formulation of laws and policies, the establishment of trade laws and regulations, the improvement of property right environment and so on.
