【摘要】：有關(guān)身份關(guān)系的協(xié)議能否適用我國《合同法》的相關(guān)規(guī)定?從文義解釋上看,《合同法》第2條第2款對(duì)此做出除外規(guī)定。不能以財(cái)產(chǎn)法中心主義的思維過度介入婚姻家庭生活領(lǐng)域。應(yīng)該對(duì)《民法總則》第11條、《合同法》第2條第2款進(jìn)行目的性限縮解釋,我國民法典應(yīng)該設(shè)置有關(guān)身份法律行為法律適用的如下一般規(guī)則:"婚姻、收養(yǎng)、監(jiān)護(hù)、贍養(yǎng)、遺贈(zèng)扶養(yǎng)等有關(guān)身份關(guān)系的民事法律行為,適用《婚姻法》、《收養(yǎng)法》、《繼承法》等法律的規(guī)定,其他法律沒有規(guī)定時(shí),在不與身份關(guān)系性質(zhì)相沖突的情況下,適用《中華人民共和國民法總則》的規(guī)定。"
[Abstract]:Can the agreement on the relationship of identity apply to the relevant provisions of the contract law of our country? From the interpretation of the meaning of the article, the contract law, the second article and the second paragraphs, should not be overly involved in the realm of marriage and family life with the thought of the centralism of the property law. The target limit should be limited to the general provisions of the civil law, the contract law, and the second second paragraphs. It is explained that the civil law of our national code should set up the following general rules concerning the application of the legal act of identity: "marriage, adoption, guardianship, support, and legacy support and other civil legal acts related to identity, and the provisions of the law, < marriage law > < adoption >, < inheritance law >; when other laws do not stipulate, they are not charged with the nature of the identity relationship." Under the circumstances, the general provisions of the People's Republic of China civil law shall apply.
