【摘要】：游戲名稱能否具備商標(biāo)的屬性,是游戲名稱商標(biāo)權(quán)保護的前提。這需要考察游戲名稱是否能夠具備商標(biāo)法要求的顯著性,能夠標(biāo)示游戲產(chǎn)品的特定來源。在判斷游戲名稱商標(biāo)侵權(quán)時,需要考察被訴侵權(quán)人的使用是否是商標(biāo)使用行為,以及是否容易導(dǎo)致相關(guān)游戲消費者發(fā)生混淆誤購。只有被訴人的行為構(gòu)成商標(biāo)使用,并且容易導(dǎo)致相關(guān)游戲消費者發(fā)生混淆,才構(gòu)成對游戲名稱商標(biāo)的侵權(quán)。有一些游戲名稱本來能夠標(biāo)示游戲產(chǎn)品的來源,但是由于管理不善,逐步演變?yōu)槟骋活悇e游戲的通用名稱。這樣,原本特有的游戲名稱成為公有領(lǐng)域內(nèi)的符號,無法受到商標(biāo)法的保護。他人使用這些游戲名稱,并不構(gòu)成商標(biāo)侵權(quán)。
[Abstract]:Whether the game name can have the trademark attribute is the premise of the game name trademark right protection. This requires examining whether the game name can have the distinctiveness required by trademark law, and whether it can indicate the specific source of the game product. In judging the infringement of game name and trademark, it is necessary to investigate whether the use of the infringer is a trademark use act, and whether it is easy to cause confusion and mispurchase of the related game consumers. Only when the defendant's behavior constitutes trademark use and easily leads to confusion among relevant game consumers, can it constitute infringement of game name trademark. There are some game names that would have been able to identify the source of a game product, but due to mismanagement, it has evolved into a generic name for a particular category of games. In this way, the original unique name of the game has become a symbol in the public domain and cannot be protected by trademark law. The use of these game names by others does not constitute trademark infringement.
