【摘要】：隨著我國體育事業(yè)的飛速發(fā)展,各類體育中的法律滯后也凸顯而出,高校體育傷害事故的法律責(zé)任承擔(dān)便是表現(xiàn)之一。目前我國高校體育傷害事故的責(zé)任和救濟(jì)措施尚未完善,就現(xiàn)有法律形勢下,限制自感風(fēng)險原則的適用,以過錯責(zé)任原則為基準(zhǔn),適當(dāng)適用過錯推定責(zé)任原則,以公平責(zé)任原則為補(bǔ)充的界定責(zé)任承擔(dān)。構(gòu)建高校體育傷害事故的預(yù)防機(jī)制,加大對學(xué)生的普法教育,盡快大范圍地推行上海試行的學(xué)校體育運(yùn)動傷害專項(xiàng)保障基金。
[Abstract]:With the rapid development of sports in China, the legal lag in all kinds of sports is also prominent. The legal liability of sports injury accidents in colleges and universities is one of the manifestations. At present, the liability and relief measures for sports injury accidents in colleges and universities in our country are not perfect. Under the existing legal situation, the principle of limitation of self-perceived risk should be applied on the basis of the principle of fault liability and the principle of presumption of fault should be properly applied. The definition of responsibility is supplemented by the principle of fair responsibility. The prevention mechanism of sports injury accidents in colleges and universities should be established, and the popularization of law education for students should be increased, and the special fund for the protection of school sports injuries in Shanghai should be implemented in a large scale as soon as possible.
