【摘要】：智能手機在最近幾年呈現(xiàn)“爆炸式”的發(fā)展,正在改變著我們的生活。智能手機行業(yè)的競爭也變得異常激烈,時常發(fā)生專利訴訟。智能手機的專利訴訟問題是一個值得研究的問題。主要智能手機企業(yè)愿意提起專利訴訟的意愿如何,所掌握的專利技術(shù)怎么樣以及國產(chǎn)智能手機的專利風(fēng)險有多大都是本文研究的內(nèi)容。企業(yè)在專利訴訟中無非充當(dāng)兩種角色,或為原告,或為被告。而在近年來的專利訴訟中,又有一種被稱為“專利流氓”的組織在專利訴訟中異常的活躍,總是充當(dāng)原告。故本文開始對NPE的概念進行梳理,定性解讀了NPE為什么會活躍于專利訴訟。此后,通過定義專利訴訟傾向的概念來反映公司愿意提起專利訴訟的意愿,從而可以定量地描述NPE。同時,選取智能手機行業(yè)一些有名的企業(yè)作為研究對象來實證研究他們的專利訴訟傾向如何,與哪些因素相關(guān),以揭示訴訟活動中的規(guī)律。必要的專利儲備是專利訴訟的有力武器。智能手機觸摸屏技術(shù)是智能手機革命性的技術(shù),也一直是專利訴訟的焦點技術(shù)。通過專利檢索分析能夠看出哪些企業(yè)在該技術(shù)領(lǐng)域占據(jù)著優(yōu)勢的地位。而一般來說,持有大量專利,占據(jù)技術(shù)優(yōu)勢地位的企業(yè),在專利訴訟活動中應(yīng)該會更積極主動。結(jié)合專利訴訟傾向和專利檢索結(jié)果,發(fā)現(xiàn)二者具有相關(guān)性也就印證上述推論。專利訴訟更多是發(fā)生在國外,以搜集到的國外手機企業(yè)充當(dāng)被告的次數(shù)作為專利風(fēng)險大小,驗證企業(yè)專利訴訟風(fēng)險與銷量正相關(guān),與專利數(shù)量負相關(guān)的結(jié)論,依據(jù)該結(jié)論對幾個最有名的國產(chǎn)智能手機的專利訴訟風(fēng)險進行評估,發(fā)現(xiàn)專利訴訟風(fēng)險由大到小依次為小米、酷派、聯(lián)想、中興、華為。
[Abstract]:Smartphones have exploded in recent years and are changing our lives. Competition in the smartphone industry has also become unusually fierce, with patent lawsuits occurring from time to time. The patent litigation of smart phone is a problem worth studying. What is the willingness of major smartphone companies to file patent litigation, how to master the patent technology and how much the patent risk of domestic smartphones are all the contents of this paper. The enterprise plays two roles in patent litigation, either plaintiff or defendant. In recent years, there is a kind of organization called "patent hooligan" in patent litigation, which always acts as plaintiff. Therefore, this paper begins to comb the concept of NPE and explain qualitatively why NPE is active in patent litigation. From then on, NPE can be quantitatively described by defining the concept of patent litigation tendency to reflect the willingness of the company to file patent litigation. At the same time, select some famous enterprises in the smartphone industry as the research object to empirically study their patent litigation tendency and the factors related to it, in order to reveal the law of litigation activities. The necessary patent reserves are a powerful weapon in patent litigation. The touch-screen technology of smart phone is the revolutionary technology of smart phone and has been the focus of patent litigation. Through patent retrieval analysis, we can see which enterprises occupy the advantage position in the field of technology. Generally speaking, enterprises that hold a large number of patents and occupy a dominant position of technology should be more active in patent litigation. Combined with patent litigation tendency and patent retrieval results, the corollary is confirmed. Patent litigation mostly happens in foreign countries. The number of times that foreign mobile phone enterprises act as defendants is taken as the patent risk. The conclusion that the risk of patent litigation is positively related to sales volume and negatively related to the number of patents is verified. According to this conclusion, the patent litigation risks of some of the most famous domestic smartphones are evaluated, and the patent litigation risks from big to small are Xiaomi, Cool faction, Lenovo, ZTE, Huawei.
