【摘要】：說明書充分公開的評價(jià)涉及到專利的整個(gè)生命周期,對專利權(quán)利的取得,權(quán)利的穩(wěn)定性都起著至關(guān)重要的作用,然而其判斷標(biāo)準(zhǔn)在各國都是一個(gè)難題。我國目前專利公開的法定要求還比較寬泛,《專利法》和《審查指南》對一些判斷標(biāo)準(zhǔn)沒有細(xì)化,導(dǎo)致審查不統(tǒng)一,嚴(yán)重困擾著相關(guān)從業(yè)人員。本文通過借鑒美國和歐洲在專利說明書充分公開判斷標(biāo)準(zhǔn)的法律規(guī)定和判例經(jīng)驗(yàn),從專利說明書充分公開的判斷的流程出發(fā),結(jié)合我國《專利法》和《審查指南》的具體規(guī)定,詳細(xì)闡述了我國專利說明書充分公開判斷實(shí)務(wù)和存在的問題,并提出了自己的建議。
[Abstract]:The evaluation of the full disclosure of the specification involves the whole life cycle of the patent and plays an important role in the acquisition of the patent right and the stability of the right. However, its judgment criterion is a difficult problem in all countries. At present, the legal requirements of patent disclosure in China are still relatively broad. The Patent Law and the examination Guide do not refine some judgment standards, which leads to the disunity of the examination, which seriously puzzles the relevant practitioners. Based on the experience of the United States and Europe in fully publicizing the judgment standard of patent specification, this paper sets out from the process of full disclosure of patent specification, and combines with the specific provisions of Patent Law and Review Guide of our country. This paper expounds in detail the practice and existing problems of fully open judgment of patent specification in China, and puts forward its own suggestions.
