【摘要】：隨著網(wǎng)絡(luò)的普及,同人作品表現(xiàn)出了顯著的商業(yè)化趨勢(shì)。但由于同人作品法律屬性模糊,并會(huì)對(duì)原著作權(quán)人的權(quán)利產(chǎn)生一定的沖擊,所以在商業(yè)化道路上存在較大阻礙。事實(shí)上,具有獨(dú)創(chuàng)性內(nèi)容的同人作品并不違背著作權(quán)法的基本宗旨,并會(huì)對(duì)原著作權(quán)人的利益產(chǎn)生積極影響。為引導(dǎo)同人創(chuàng)作合法有序發(fā)展,我國(guó)應(yīng)進(jìn)一步完善同人作品的獨(dú)創(chuàng)性判斷標(biāo)準(zhǔn)并構(gòu)建規(guī)范化的著作權(quán)許可平臺(tái)。
[Abstract]:With the popularity of the network, coworkers' works show a remarkable trend of commercialization. However, due to the ambiguous legal attributes of co-owner 's works, and will have a certain impact on the rights of the original copyright owner, there are great obstacles on the road of commercialization. In fact, the original co-owner 's works are not contrary to the basic purpose of copyright law, and will have a positive impact on the interests of the original copyright owner. In order to guide the legal and orderly development of co-creation, our country should further improve the criteria of originality of the works and construct a standardized copyright licensing platform.
