【摘要】：貴州省自2009年開(kāi)始實(shí)施創(chuàng)新技術(shù)工程以來(lái),產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟得到了快速發(fā)展,尤其是2012年1月12日,國(guó)務(wù)院頒布了《關(guān)于進(jìn)一步促進(jìn)貴州經(jīng)濟(jì)社會(huì)又好又快發(fā)展的若干意見(jiàn)》以來(lái),貴州省產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟得到法律和政策的支持鼓勵(lì),發(fā)展速度更加迅猛。但是在這五年的發(fā)展過(guò)程中,貴州省產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟面臨一系列的法律問(wèn)題,缺乏系統(tǒng)法律的指導(dǎo),地方性法規(guī)沒(méi)有體現(xiàn)地方特色等問(wèn)題嚴(yán)重,在一定程度上阻礙了貴州省產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟的進(jìn)一步發(fā)展。因此,對(duì)于貴州省產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟法律問(wèn)題的研究變得尤為重要。本文的第一部分闡述了對(duì)貴州省產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟法律問(wèn)題研究的重要性,闡明貴州省產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟法律體系應(yīng)該發(fā)揮的作用以及與現(xiàn)實(shí)存在的差距,指明研究的必要性。本文的第二部分闡述了貴州省產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟相關(guān)法律制度的現(xiàn)狀,從中央立法、地方立法和契約對(duì)聯(lián)盟的法律效力三個(gè)部分進(jìn)行闡述。本文的第三部分和第四部分是文章的重心,根據(jù)文章第二部分貴州省產(chǎn)業(yè)技術(shù)創(chuàng)新戰(zhàn)略聯(lián)盟發(fā)展中依靠的法律制度,重點(diǎn)闡述了聯(lián)盟在具體制度、體系以及地方特色方面存在的相關(guān)法律問(wèn)題,并為如何解決這些法律問(wèn)題提出建議。
[Abstract]:Since the implementation of innovative technology projects in Guizhou Province in 2009, the strategic alliance of industrial technological innovation has developed rapidly, especially on January 12, 2012. Since the State Council promulgated some opinions on how to further promote the sound and rapid development of Guizhou's economy and society, the strategic alliance of industrial and technological innovation in Guizhou Province has been encouraged by laws and policies, and the speed of development has been even faster. However, in the course of these five years of development, the strategic alliance of industrial technological innovation in Guizhou Province is faced with a series of legal problems, lacking systematic legal guidance, and the local laws and regulations do not reflect local characteristics and other serious problems. To some extent, it hinders the further development of the strategic alliance of industrial technological innovation in Guizhou province. Therefore, the study on the strategic alliance of industrial technological innovation in Guizhou becomes particularly important. The first part of this paper expounds the importance of the study on the legal problems of the strategic alliance of industrial technological innovation in Guizhou Province, and expounds the role that the legal system of the strategic alliance of industrial technological innovation in Guizhou should play and the gap between the legal system and the reality. Indicate the need for research. The second part of this paper expounds the current situation of the relevant legal system of the strategic alliance of industrial technological innovation in Guizhou province, from three parts: central legislation, local legislation and contract to the legal effect of the alliance. The third and fourth parts of this paper are the focus of the article, according to the second part of the article of Guizhou Province industrial technology innovation strategic alliance development relying on the legal system, focusing on the alliance in the specific system, System and local characteristics of the relevant legal problems, and how to solve these legal problems.
