本文選題：反壟斷 + 知識產(chǎn)權(quán)��； 參考：理論上的合理性及執(zhí)行中的困難

【摘要】：與知識產(chǎn)權(quán)相關(guān)的反壟斷法問題的核心,是如何在知識產(chǎn)權(quán)追求的動態(tài)效率與反壟斷法維護(hù)的靜態(tài)效率之間取得某種平衡。這種平衡的取得需要對個案具體問題進(jìn)行具體分析,即適用合理原則或基于效率的分析方法。本文在闡明合理原則與當(dāng)然違法原則內(nèi)涵的基礎(chǔ)上,進(jìn)一步分析在與知識產(chǎn)權(quán)相關(guān)的反壟斷問題中適用的合理性以及執(zhí)行中的困難,提出可能的解決方案。
[Abstract]:The core of anti-monopoly law related to intellectual property is how to strike a balance between the dynamic efficiency pursued by intellectual property and the static efficiency maintained by anti-monopoly law. In order to achieve this balance, it is necessary to analyze the specific problems of individual cases, that is to say, to apply the principle of reasonableness or the analysis method based on efficiency. On the basis of expounding the connotation of the principle of reasonableness and the principle of illegality of course, this paper further analyzes the rationality of the application in the antitrust problems related to intellectual property and the difficulties in the implementation, and puts forward the possible solutions.
