【摘要】:網(wǎng)絡(luò)購物已成為我國消費(fèi)者尤其是年輕消費(fèi)者的重要購物方式,它具有傳統(tǒng)購物方式無法比擬的便利性,但是由于網(wǎng)絡(luò)購物自身虛擬性、跨區(qū)域性等特點(diǎn),使網(wǎng)絡(luò)消費(fèi)者的權(quán)益很容易受到侵害而不易維權(quán)。我國立法機(jī)關(guān)注意到這一問題,在充分征求民眾意見的基礎(chǔ)上于2013年頒布了新的《消費(fèi)者權(quán)益保護(hù)法》,其第25條對“七天無理由退貨”的規(guī)定就是解決網(wǎng)絡(luò)、電視、電話、郵購等新型購物模式中消費(fèi)者權(quán)益易受侵害的問題。由于這是我國首次在國家立法層面上規(guī)定這一新型權(quán)利,學(xué)術(shù)界針對此項(xiàng)權(quán)利研究的著作較少,對此項(xiàng)權(quán)利的定義也不統(tǒng)一,有的稱之為“反悔權(quán)”,有的直接稱之為“七天無理由退貨”制度,英美法系國家的學(xué)術(shù)界一般稱之為“冷靜期制度”。本文結(jié)合民法的基本理論和我國立法實(shí)踐的基本情況,將其定義為消費(fèi)者“后悔權(quán)”,為此項(xiàng)權(quán)利的研究留有更大發(fā)展空間。我國后悔權(quán)較國外起步較晚,這條規(guī)定只是對后悔權(quán)的初步探索,規(guī)定還不夠細(xì)致完善,針對我國網(wǎng)絡(luò)購物中日益復(fù)雜的購物環(huán)境還不能有效的應(yīng)對。有必要對后悔權(quán)進(jìn)行全面而深入的研究。本文主要研究消費(fèi)者后悔權(quán)的基本理論及在立法和實(shí)施中存在的問題。采用案例分析法、比較分析法、理論聯(lián)系實(shí)踐法等研究方法,分六部分對消費(fèi)者后悔權(quán)進(jìn)行研究。第一部分緒論通過三個典型的案例引出本文要研究的問題。第二部分是對消費(fèi)者后悔權(quán)基本理論的研究,包括對消費(fèi)者“后悔權(quán)”定義的合理性進(jìn)行論證,消費(fèi)者后悔權(quán)的性質(zhì)、特征及與相關(guān)概念的區(qū)別。第三部分主要介紹了消費(fèi)者后悔權(quán)在我國與國外立法狀況及它們之間的不同。第四部分主要是找出我國消費(fèi)者后悔權(quán)在立法及實(shí)施中存在的問題。第五部分是針對后悔權(quán)存在的問題提出的解決措施。第六部分是結(jié)論,對全文進(jìn)行總結(jié),指出消費(fèi)者后悔權(quán)在我國得以確立對網(wǎng)絡(luò)交易健康發(fā)展的重要意義,并對網(wǎng)絡(luò)購物中消費(fèi)者后悔權(quán)在我國的發(fā)展做出展望。
[Abstract]:Internet shopping has become an important shopping method for Chinese consumers, especially young consumers. It has unparalleled convenience compared with traditional shopping methods, but because of its own virtual, cross-regional and so on. So that the rights and interests of network consumers are vulnerable to infringement and not easy to protect their rights. Taking note of this problem, the Chinese legislature, on the basis of full consultation with the public, promulgated the new Consumer Rights and interests Protection Law in 2013. Article 25 of the law stipulates that "seven days without reason to return goods" is a solution to the network, television, and telephone. In the new shopping mode such as mail order, consumers' rights and interests are vulnerable to infringement. Since this is the first time in China to stipulate this new right on the level of national legislation, the academic research on this right is less, and the definition of this right is not uniform, some of them call it the "right of retrogression". Some people call it "seven days without reason" system, and the academic circles in Anglo-American law system generally call it "cooling-off period system". Combined with the basic theory of civil law and the basic situation of our country's legislative practice, this paper defines it as "regret right" for consumers, leaving more room for the research of this right. The right of regret in our country starts later than that in foreign countries. This regulation is only a preliminary exploration of the right of regret, and it is not perfect enough to deal with the increasingly complex shopping environment in our country's online shopping. It is necessary to conduct a comprehensive and in-depth study of the right of regret. This paper mainly studies the basic theory of consumer's right of regret and the existing problems in legislation and implementation. Using case analysis, comparative analysis, theory combined with practice and other research methods, it is divided into six parts to study the right of consumer regret. The first part of the introduction leads to the problems of this paper through three typical cases. The second part is the research on the basic theory of consumer's right of regret, including the rationality of consumer's definition of "right of regret", the nature, characteristics and difference between consumer's right of regret and related concepts. The third part mainly introduces the legislative situation and differences between China and foreign countries. The fourth part is to find out the problems existing in the legislation and implementation of the right of consumer regret in our country. The fifth part is to solve the problem of the right of regret. The sixth part is the conclusion, summarizes the full text, points out that the consumer regret right can establish the important significance to the healthy development of the network transaction in our country, and makes the prospect to the consumer regret right development in our country in the network shopping.
