【摘要】：旅游業(yè)在我國作為一種朝陽產(chǎn)業(yè),當(dāng)前的發(fā)展速度相當(dāng)?shù)难该?一方面,它促進(jìn)和帶動了國民經(jīng)濟(jì)的發(fā)展,另一方面也滿足了現(xiàn)代人們在精神上的需求。隨著近些年來經(jīng)濟(jì)的提高發(fā)展,作為一項娛樂以及消費(fèi)活動,旅游業(yè)已經(jīng)開始逐漸在生活中占據(jù)著舉足輕重的地位,在許多人的生活水平得到了改善的同時,便開始注重旅游活動所帶來的精神上的享受。在旅游的過程中,既能夠感受到每個不同地方的風(fēng)土人情,又可以領(lǐng)略到當(dāng)?shù)靥厥獾娘嬍澈蛡鹘y(tǒng)文化等。旅游業(yè)的上升空間依然會有所提升,更有足夠的潛力有待發(fā)掘,而且旅游消費(fèi)也成為了多數(shù)人不可避免的日常消費(fèi)活動,不過在發(fā)展前進(jìn)的過程中,旅游活動數(shù)量的增加,也導(dǎo)致了糾紛頻繁的發(fā)生,旅游消費(fèi)者權(quán)益被侵害的現(xiàn)象更是屢禁不止,在這種情形下,相關(guān)的保障措施隨著旅游業(yè)的發(fā)展一時成為熱議的焦點(diǎn)問題。旅游消費(fèi)者在作為旅游業(yè)的主體的同時,其合法權(quán)益需要給予相對應(yīng)的合法保障,否則,旅游業(yè)的發(fā)展將是曇花一現(xiàn)。旅游業(yè)的發(fā)展要和法治建設(shè)的步調(diào)一致,這才能針對旅游消費(fèi)者權(quán)益提供出有效保障,可以讓旅游業(yè)良好有序的運(yùn)行。本文將從旅游消費(fèi)者權(quán)益的概念以及特征入手,然后分析我國旅游消費(fèi)者權(quán)益保護(hù)的現(xiàn)狀及產(chǎn)生的原因,并提出一些完善方面的建議和自身觀點(diǎn)。首先,通過闡述旅游消費(fèi)者的概念,指出旅游消費(fèi)者權(quán)益的特殊性,并探討了旅游消費(fèi)者權(quán)益的理論基礎(chǔ);其次,簡要的總結(jié)了我國旅游消費(fèi)者權(quán)益的現(xiàn)狀,指出了存在的問題并且用自己的觀點(diǎn)去看待相關(guān)的問題;最后,對旅游消費(fèi)者權(quán)益的制度和立法完善等方面提出自己的建議,希望通過一系列思考研究提出可行性的措施對權(quán)益進(jìn)行保障,促進(jìn)和維護(hù)我國旅游行業(yè)的健康發(fā)展。
[Abstract]:Tourism in China as a sunrise industry, the current speed of rapid development, on the one hand, it promotes and drives the development of the national economy, on the other hand, to meet the spiritual needs of modern people. With the development of economy in recent years, as an entertainment and consumption activities, tourism has begun to gradually be in Life occupies a pivotal position. While many people have improved their living standards, they begin to pay attention to the spiritual enjoyment of tourism. In the course of tourism, we can not only feel the customs of every different places, but also enjoy the special diet and traditional culture. The increase of space will still be improved, more potential is still to be found, and tourism consumption has become an inevitable daily consumption activity for most people. However, in the process of development, the increase in the number of tourism activities also leads to frequent disputes, and the phenomenon of the infringement of tourists' rights and interests is more and more prohibited. Under the circumstances, the related safeguard measures have become the focus of hot discussion with the development of the tourism industry. Tourism consumers, while being the main body of tourism, need to give legal protection to their legitimate rights and interests. Otherwise, the development of tourism will be a flash in the pan. The development of Tourism industry is in the same pace with the rule of law. In order to provide effective guarantee for the rights and interests of tourist consumers, the tourism industry can run well and orderly. This paper will start with the concept and characteristics of the rights and interests of tourism consumers, and then analyze the status and causes of the protection of the rights and interests of tourist consumers in our country, and put forward some suggestions and own views. The concept of tourist consumers, points out the particularity of the rights and interests of tourist consumers, and discusses the theoretical basis of the rights and interests of tourist consumers. Secondly, it briefly summarizes the current situation of the rights and interests of tourist consumers in China, points out the existing problems and views the related questions with their own views; finally, the system and legislation of the rights and interests of tourist consumers are made. The suggestions are put forward in the aspects of perfection and so on. We hope to guarantee the rights and interests through a series of thinking and research measures to promote and maintain the healthy development of the tourism industry in China.
