【摘要】：隨著信息網(wǎng)絡(luò)技術(shù)的不斷發(fā)展,數(shù)字環(huán)境下的知識(shí)產(chǎn)權(quán)保護(hù)和執(zhí)法逐漸成為一項(xiàng)重要的課題。1996年世界知識(shí)產(chǎn)權(quán)組織因特網(wǎng)條約對權(quán)利管理信息保護(hù)進(jìn)行了專門規(guī)定,首次在國際法層面上要求各成員國對于權(quán)利管理信息提供適當(dāng)和有效的法律救濟(jì)。由于因特網(wǎng)條約僅提供了一個(gè)保護(hù)權(quán)利管理信息的基本框架,各成員國在很大程度上可以自由決定如何履行其國際法義務(wù)。比較各國履行因特網(wǎng)條約權(quán)利管理保護(hù)條款的國內(nèi)立法,主要差異體現(xiàn)在權(quán)利管理信息定義、禁止行為、主觀認(rèn)知要求、例外限制情形以及法律救濟(jì)方式五個(gè)方面。我國《著作權(quán)法第三次修改草案》在現(xiàn)行立法的基礎(chǔ)上對權(quán)利管理信息提供了較為詳盡合理的規(guī)定,但仍然存在一定不足有待明確。
[Abstract]:With the continuous development of information network technology, the protection and enforcement of intellectual property rights in the digital environment has gradually become an important issue. The 1996 World intellectual property Organization Internet Treaty provides for the protection of rights management information. For the first time in international law, member states are required to provide appropriate and effective legal remedies for rights management information. Since Internet treaties provide only a basic framework for the management of information on the protection of rights, member States are largely free to decide how to fulfil their obligations under international law. This paper compares the domestic legislation of various countries in implementing the provisions of Internet treaty rights management and protection. The main differences are reflected in five aspects: the definition of right management information, the prohibition of behavior, the subjective cognitive requirement, the exception restriction and the legal remedy. The third revision draft of copyright Law in China provides more detailed and reasonable provisions on the information of right management on the basis of current legislation, but there are still some shortcomings to be clarified.
