建筑物區(qū)分所有之成員權(quán)行使問題研究

【摘要】:近年來,建筑物區(qū)分所有權(quán)中的管理性權(quán)利——成員權(quán)的重要性日益彰顯。事實(shí)上,我國《物權(quán)法》在成員權(quán)的性質(zhì)界定、權(quán)利行使及救濟(jì)等方面并未提供明確的指導(dǎo)。為了解決因法律缺位造成的種種不便,有效地保護(hù)業(yè)主利益,本文擬通過對(duì)國外(地區(qū))成員權(quán)制度進(jìn)行比較研究,對(duì)我國現(xiàn)行制度運(yùn)行中存在的問題進(jìn)行梳理,并為我國成員權(quán)制度的完善提供可行性建議。本文由以下五個(gè)章節(jié)組成:第一章是成員權(quán)的概念及性質(zhì)界定。在“三元論”的基礎(chǔ)上,“物法性說”和“人法性說”都難以包容成員權(quán)的性質(zhì),應(yīng)當(dāng)將成員權(quán)劃入社員權(quán)范疇,成員權(quán)是區(qū)別于傳統(tǒng)民事權(quán)利的獨(dú)立的新型民事權(quán)利。第二章是國外及我國臺(tái)灣地區(qū)成員權(quán)行使法律制度的比較法研究。西方各國的成員權(quán)行使制度無不受到“三權(quán)分立”理論的深刻影響,普遍建立的都是權(quán)力機(jī)關(guān)、執(zhí)行機(jī)關(guān)和監(jiān)督機(jī)關(guān)的三層模式。德國《住宅所有權(quán)法》將住宅所有權(quán)人作為一個(gè)獨(dú)立的管理機(jī)關(guān),法國對(duì)于管理機(jī)關(guān)的組成人員規(guī)定較為靈活多樣,以及各個(gè)國家對(duì)于監(jiān)督制度的圓滑設(shè)置等,都值得我國立法者在立法時(shí),選擇性地學(xué)習(xí)借鑒。第三章是我國建筑物區(qū)分所有權(quán)中成員權(quán)行使存在的問題。由于現(xiàn)行法律存在漏洞,導(dǎo)致了在實(shí)踐中成員權(quán)的行使都存在問題。第四章是成員權(quán)行使的理論分析。管理團(tuán)體是成員權(quán)的行使機(jī)構(gòu),當(dāng)前各國均趨向于承認(rèn)管理團(tuán)體具有法人資格,這便于管理團(tuán)體以自己的名義行使包括經(jīng)濟(jì)活動(dòng)、司法活動(dòng)在內(nèi)的管理職權(quán)。區(qū)分所有人在不違反強(qiáng)制性規(guī)定的前提下,可根據(jù)需要自行選擇管理方式,這也體現(xiàn)了業(yè)主自治精神。業(yè)主大會(huì)和業(yè)主委員會(huì)作為決策機(jī)構(gòu)和執(zhí)行機(jī)構(gòu),是維持成員權(quán)正常行使的重要保證。第五章是我國建筑物區(qū)分所有權(quán)之成員權(quán)行使制度的完善。針對(duì)成員權(quán)行使中出現(xiàn)的問題,出臺(tái)一部《建筑物區(qū)分所有權(quán)法》勢在必行,完善業(yè)主大會(huì)召開機(jī)制,明確業(yè)委會(huì)的法律地位,建立監(jiān)督機(jī)構(gòu),以真正維護(hù)業(yè)主權(quán)益。
[Abstract]:In recent years, the importance of management right-member right in building ownership is becoming more and more obvious. In fact, China's Real right Law does not provide clear guidance in defining the nature of membership rights, exercising rights and remedies. In order to solve the inconvenience caused by the absence of law and protect the interests of the owner effectively, this paper intends to make a comparative study of the foreign (regional) member right system, and to sort out the existing problems in the operation of the current system in our country. And provides the feasible suggestion for our country member right system consummation. This paper consists of the following five chapters: the first chapter is the definition of the concept and nature of membership rights. On the basis of "ternary theory", both "material law theory" and "person law nature theory" are difficult to contain the nature of membership rights. Membership rights should be classified into the category of membership rights, which is an independent new civil right which is different from traditional civil rights. The second chapter is a comparative study on the legal system of the exercise of membership rights in foreign countries and Taiwan. The system of exercising member rights in western countries is deeply influenced by the theory of "separation of powers". What is generally established is the three-tiered mode of power organ, executive organ and supervision organ. The German "Law on Housing ownership" regards the owner of the house as an independent administrative organ, and France has more flexible and diverse regulations on the composition of the administrative organ, as well as the sleek setting of the supervisory system in various countries, and so on. It is worth studying and learning selectively when legislating in our country. The third chapter is about the existing problems in the exercise of the member right in the building ownership division in our country. Because of the loopholes in the current law, there are problems in the exercise of the member's right in practice. The fourth chapter is the theoretical analysis of the exercise of membership rights. Management group is the executive body of the member right. At present, all countries tend to recognize that the management group has legal personality, which is convenient for the management group to exercise its administrative power including economic activities and judicial activities in its own name. Differentiation between owners in the premise of not violating mandatory provisions, according to the needs of their own choice of management, which also reflects the spirit of owner autonomy. As a policy-making and executive organ, the owners' Congress and the owners' committee are the important guarantee to maintain the normal exercise of membership rights. The fifth chapter is the perfection of the exercise system of the member right of building division ownership in our country. In view of the problems in the exercise of members' rights, it is imperative to issue a law of building condominium, perfect the convening mechanism of the owners' Congress, clarify the legal status of the industrial committee, and establish the supervisory organization to truly safeguard the owners' rights and interests.
