【摘要】：自1985年《繼承法》頒布實施到現(xiàn)在,社會結(jié)構(gòu)和社會關(guān)系發(fā)生了巨大變化,可是繼承法卻并沒有隨著社會的變化而進行全面的修改。繼承法中的遺囑執(zhí)行人制度還是僅僅是一句籠統(tǒng)的條文,在實踐中并沒有可供操作的規(guī)定。對遺囑執(zhí)行人進行細(xì)化規(guī)定,既符合目前的現(xiàn)實需要,又符合群眾的呼聲,又能對我國目前民法典的完善建言獻策。筆者通過比較其他國家和地區(qū)的立法,總結(jié)成熟的立法的經(jīng)驗,分析我國實際問題,期望能對遺囑執(zhí)行人制度的細(xì)化提供合理的建議。本文內(nèi)容包含四個部分:首先是遺囑人執(zhí)行制度在先行立法中存在的問題。通過對我國現(xiàn)行立法的探析,發(fā)現(xiàn)目前立法中存在的缺陷以及在現(xiàn)實中存在的問題。通過待解決的問題來證明執(zhí)行人制度的分析價值。其次是遺囑執(zhí)行人法律地位的研究。遺囑執(zhí)行人地位的說明就像是一張身份證,多數(shù)國家對遺囑執(zhí)行人地位并沒有一個明確的結(jié)論。通過對各種學(xué)說的考察,筆者支持固有權(quán)說的任務(wù)說。再次是對不同國家和地區(qū)遺囑執(zhí)行人制度的考察。通過對德國、法國、澳門、臺灣、英國、香港等地的遺囑執(zhí)行人產(chǎn)生,任職資格和權(quán)利義務(wù)方面的規(guī)定的研究,借鑒成熟的立法經(jīng)驗。最后是完善遺囑執(zhí)行人制度的思考。通過對比各國的成熟立法,并結(jié)合我國的實踐,主要從遺囑執(zhí)行人的產(chǎn)生、任職資格和權(quán)利義務(wù)三個方面進行完善。
[Abstract]:Since the enactment and implementation of the inheritance Law in 1985, great changes have taken place in the social structure and social relations, but the inheritance Law has not been comprehensively amended with the social changes. The executor system in succession law is only a general clause, and there is no operational provision in practice. The detailed stipulation of executor is not only in line with the needs of the present reality, but also with the voice of the masses, and it can also make suggestions for the perfection of the present civil code of our country. By comparing the legislation of other countries and regions, the author summarizes the experience of mature legislation, analyzes the practical problems in our country, and expects to provide reasonable suggestions for the refinement of executor system. This paper includes four parts: firstly, the problems of testator execution system in advance legislation. Through the analysis of the current legislation in our country, the defects and problems in the current legislation are found. Through the problems to be solved to prove the value of the executor system. Secondly, the research on the legal status of executor. The description of executor's status is like an ID card, and most countries have no clear conclusion about executor's status. Through the investigation of various theories, the author supports the mission theory. Thirdly, it examines the system of executor in different countries and regions. Through the study of the provisions on the generation, qualification, rights and obligations of executors in Germany, France, Macao, Taiwan, Britain, Hong Kong and other places, we can learn from the mature legislative experience. Finally, the author thinks about how to perfect the executor system. By comparing the mature legislation of various countries and combining the practice of our country, we can perfect it mainly from three aspects: the generation of executor, the qualification of appointment and the rights and obligations.
