業(yè)主表決權(quán)法律制度研究

【摘要】:我們?nèi)粘5纳顓^(qū)域主要是小區(qū),因而小區(qū)物業(yè)的好壞直接影響著我們每個(gè)人的日常生活。目前,我國對(duì)小區(qū)物業(yè)的管理主要是實(shí)行業(yè)主自治的管理模式,即由全體業(yè)主自行決定小區(qū)物業(yè)的管理及維護(hù)等問題。然而,我國對(duì)業(yè)主自治的管理模式僅對(duì)原則性問題進(jìn)行了規(guī)定,對(duì)具體的管理措施沒有給出明確的答案。2007年頒布的《物權(quán)法》只是對(duì)小區(qū)的物業(yè)管理進(jìn)行了原則性的規(guī)定,指出由業(yè)主自行決定物業(yè)小區(qū)的管理,即業(yè)主自治。但是對(duì)業(yè)主自治的具體措施卻規(guī)定的模糊不清,或者說業(yè)主自治的制度在具體運(yùn)用上存在立法缺失。業(yè)主自治主要是指小區(qū)的某一共同管理事務(wù)通過業(yè)主投票權(quán)來決定,即業(yè)主通過“舉手表決”來表達(dá)自己對(duì)小區(qū)的某一管理事項(xiàng)的同意與否。因此,業(yè)主表決權(quán)是業(yè)主自治的具體體現(xiàn),對(duì)業(yè)主自治有著至關(guān)重要的作用。然而,目前我國法律對(duì)于業(yè)主表決權(quán)的主體范圍、表決權(quán)確定的標(biāo)準(zhǔn)及表決權(quán)的決議規(guī)則等核心問題都沒有具體的規(guī)定,以至于在實(shí)踐中業(yè)主表決權(quán)的行使遇到眾多困難。到目前為止,業(yè)主表決權(quán)制度的具體操作方法及措施并沒有具體、明確的法律規(guī)定,理論界對(duì)此問題也因存在諸多爭議而沒有給予明確的指導(dǎo),導(dǎo)致實(shí)踐中業(yè)主行使其表決權(quán)時(shí)會(huì)面臨諸多困境以致無法解決的問題,業(yè)主自治的法律原則猶如形同虛設(shè),并沒能發(fā)揮其實(shí)際作用。業(yè)主的表決權(quán)關(guān)乎于我們每個(gè)小區(qū)的物業(yè)管理,關(guān)乎于我們每個(gè)人的生活環(huán)境,關(guān)乎于我們每個(gè)業(yè)主對(duì)物業(yè)管理的權(quán)利問題,是業(yè)主自治的充分體現(xiàn),因而我們應(yīng)重視業(yè)主表決權(quán)制度的具體施行,F(xiàn)階段由于立法上對(duì)業(yè)主表決權(quán)制度具體操作上存在缺失,理論界因“聲音不統(tǒng)一”也沒能給出明確的指導(dǎo),以至于實(shí)踐中業(yè)主表決權(quán)制度很難具體的落到實(shí)處。因此,本論文選題具有較為明顯的理論價(jià)值和現(xiàn)實(shí)意義。就理論價(jià)值而言,本項(xiàng)研究對(duì)業(yè)主表決權(quán)的法理基礎(chǔ)、行使方式和程序、行使效力以及權(quán)利保護(hù)展開全面的理論分析,從而使業(yè)主表決權(quán)制度在理論上得以完備;就現(xiàn)實(shí)意義而言,本項(xiàng)研究有助于我國對(duì)當(dāng)前立法中有關(guān)業(yè)主表決權(quán)的規(guī)定加以完善建議,有助于規(guī)范業(yè)主表決權(quán)的確認(rèn)、行使、保障等全過程,有助于在法治的框架下推動(dòng)業(yè)主自治的實(shí)現(xiàn)。此外,還能對(duì)涉及業(yè)主表決權(quán)的司法實(shí)踐起到積極的指導(dǎo)作用。
[Abstract]:Our daily life area is mainly a residential area, so the quality of residential property directly affects our daily life. At present, the management of residential property in our country is mainly to implement the management mode of owner autonomy, that is, all the owners decide the management and maintenance of the residential property by themselves. However, the management mode of owner autonomy in our country has only stipulated the principle question, and has not given the clear answer to the concrete management measure. The property Law promulgated in 2007 only has carried on the principle stipulation to the real estate management of the community. It is pointed out that the owner decides the management of the property district by himself, that is, the owner's autonomy. However, the specific measures of owner autonomy are vague, or the system of owner autonomy is lack of legislation. Owner autonomy mainly refers to a common management business in a community to decide through the voting rights of the owner, that is, the owner expresses his consent to a certain management matter by "show of hands". Therefore, the owner's voting right is the concrete embodiment of owner's autonomy, and plays a vital role in owner's autonomy. However, at present, the law of our country has no specific provisions for the scope of the main body of the owner's voting right, the standard for the determination of the voting right and the rules for the resolution of the voting right, so that in practice, the exercise of the owner's voting right encounters many difficulties. Up to now, the concrete operation methods and measures of the owner's voting right system have not specific, clear legal stipulation, the theorists have not given clear guidance to this question because there are many disputes. As a result, the owners will face many difficult problems when they exercise their voting rights in practice. The legal principle of owner autonomy is just like a virtual one, and fails to play its practical role. The voting rights of the owners are related to the property management of each of our communities, to the living environment of each of us, to the rights of each of our owners to the management of the property, and to the full embodiment of the autonomy of the owners, Therefore, we should attach importance to the implementation of the owners voting rights system. At the present stage, because of the lack of legislation on the concrete operation of the owner's voting system, the theoretical circle is unable to give clear guidance because of "disunity of voice", so it is very difficult to implement the owner's voting right system in practice. Therefore, this thesis has obvious theoretical value and practical significance. As far as the theoretical value is concerned, this study makes a comprehensive theoretical analysis of the legal basis, the exercise mode and procedure, the effectiveness of the exercise and the protection of the right of owners' voting rights, thus making the system of owners' voting rights complete in theory. As far as practical significance is concerned, this study is helpful to perfect and suggest the provisions of current legislation on owners' voting rights in our country, and to standardize the whole process of confirming, exercising and safeguarding owners' voting rights. It is helpful to promote the realization of owner autonomy under the framework of rule of law. In addition, it can also play a positive guiding role in the judicial practice involving owners' voting rights.
