【摘要】：在新的《最高人民法院關(guān)于適用〈中華人民共和國民事訴訟法〉的解釋》發(fā)布之后,我國民事訴訟法雖然在"以信息網(wǎng)絡(luò)方式訂立的買賣合同糾紛的管轄權(quán)"和"信息網(wǎng)絡(luò)侵權(quán)行為糾紛管轄權(quán)"方面做了一些補(bǔ)充和完善,但是,通過對現(xiàn)有立法的仔細(xì)研究,不難發(fā)現(xiàn)此次修改后仍然還是存在許多不足之處。所以,本文認(rèn)為針對這些不足有必要結(jié)合國內(nèi)外一些成功的經(jīng)驗(yàn)和司法實(shí)踐中的一些經(jīng)驗(yàn),進(jìn)行進(jìn)一步的完善。
[Abstract]:After the promulgation of the new interpretation of the Supreme people's Court on the Application of the Civil procedure Law of the people's Republic of China, Although the Civil procedure Law of our country has made some supplement and perfection in the aspects of "jurisdiction of contract of sale and sale dispute concluded by information network" and "jurisdiction of tort dispute of information network", but through the careful study of the existing legislation, It is not difficult to find that there are still many shortcomings after the revision. Therefore, it is necessary to combine some successful experience at home and abroad and some experience in judicial practice.
