【摘要】：隨著知識經(jīng)濟時代的到來,大學將成為我國知識創(chuàng)新的一支重要力量。當前面對國內(nèi)外激烈的競爭,遼寧省科技與經(jīng)濟脫節(jié)的問題依然嚴重,教育對經(jīng)濟的支撐作用未能充分發(fā)揮出來,將遼寧省建設成為科技強省,必須依靠在遼高校這支重要的科技力量,加快遼寧省高校專利成果向現(xiàn)實生產(chǎn)力的轉(zhuǎn)化。據(jù)此,論文從法律制度上分析了制約遼寧省高校專利技術(shù)轉(zhuǎn)化的因素,剖析了遼寧省高校專利技術(shù)轉(zhuǎn)化存在的法律問題,并提出了完善高校專利技術(shù)轉(zhuǎn)化法律制度的可行建議。論文首先闡述了高校專利技術(shù)轉(zhuǎn)化法律制度的概念界定,梳理了高校專利技術(shù)轉(zhuǎn)化的法律體系架構(gòu),分析了完善高校專利技術(shù)轉(zhuǎn)化法律制度的必要性。其次,以遼寧省高校專利技術(shù)轉(zhuǎn)化為視角分析了相關(guān)政策法規(guī)在高校專利技術(shù)轉(zhuǎn)化中實施的效果及存在的問題,存在的法律問題主要有:高校專利技術(shù)轉(zhuǎn)化法律制度不健全;人才隊伍建設政策落實不到位;收益分配、稅收優(yōu)惠等激勵制度不完善;風險投資、科技投入等投資政策落實不到位;產(chǎn)學研合作、科技機構(gòu)建設仍缺乏強有力的保障。最后,在借鑒我國其他省市及美國和日本在高校專利技術(shù)轉(zhuǎn)化中的立法實踐的基礎上,從健全高校專利技術(shù)轉(zhuǎn)化相關(guān)法律制度、落實高校專利技術(shù)轉(zhuǎn)化人才隊伍建設政策、完善高校專利技術(shù)轉(zhuǎn)化激勵法律制度、健全高校專利技術(shù)轉(zhuǎn)化投資法律體系、規(guī)范高校專利技術(shù)轉(zhuǎn)化渠道法律體系等五個方面提出了完善遼寧省高校專利技術(shù)轉(zhuǎn)化法律制度的建議,以期能有效促進遼寧省高校專利技術(shù)轉(zhuǎn)化,提高我省綜合實力。
[Abstract]:With the advent of the era of knowledge economy, universities will become an important force in the innovation of knowledge in China. Facing the fierce competition at home and abroad, the problem of disconnection between science and technology and economy in Liaoning is still serious, the supporting role of education on economy has not been fully played out, and the construction of Liaoning province into a strong province of science and technology must depend on the University of Liao. By supporting the important scientific and technological forces to speed up the transformation of the patent achievements of colleges and universities in Liaoning province to the actual productive forces, the paper analyzes the factors that restrict the transformation of patent technology in Colleges and universities in Liaoning province from the legal system, analyzes the legal problems of the transformation of the patent technology in Universities in Liaoning Province, and puts forward the legal system for the perfection of the transformation of the patent technology in Colleges and universities. The paper first expounds the definition of the legal system of university patent technology transformation, combs the legal system structure of the transformation of patent technology in Colleges and universities, analyzes the necessity of perfecting the legal system of the transformation of patent technology in Colleges and universities. Secondly, it analyzes the relevant policies and regulations in the patent technology of colleges and universities in the perspective of the transformation of the patent technology of universities in Liaoning province. The effect and the existing problems in the transformation of the operation are as follows: the legal system of the transformation of the university patent technology is not perfect; the policy implementation of the talent team construction is not in place; the incentive system of the income distribution and tax preference is not perfect; the investment policies such as the venture investment and the scientific and technological investment are not in place; the production, research and research cooperation, the scientific and Technological Institution The construction still lacks strong guarantee. Finally, on the basis of the legislative practice of other provinces and cities and the United States and Japan in the transformation of university patent technology, we should improve the relevant legal system of the transformation of patent technology in Colleges and universities, implement the policy of the construction of the personnel of the university patent technology transformation, and perfect the legal system of the transformation of the patent technology transformation of the University. To improve the legal system of patent technology transformation investment and standardize the legal system of the transformation channel of patent technology in Colleges and universities, five suggestions are put forward to improve the legal system of the transformation of patent technology in Colleges and universities in Liaoning Province, in order to effectively promote the transformation of patent technology in universities and colleges in Liaoning province and improve the comprehensive strength of our province.
