【摘要】：與傳統(tǒng)的名譽(yù)權(quán)相比較,其實(shí)微博名譽(yù)權(quán)并不算新的東西,二者沒(méi)有什么實(shí)質(zhì)性的差別。微博以互聯(lián)網(wǎng)為載體,造就了它傳播速度快,影響范圍廣的特點(diǎn),同時(shí)也帶來(lái)了侵權(quán)的便利性,近年來(lái)微博名譽(yù)侵權(quán)案件層出不窮。在法律適用上,沒(méi)有一個(gè)專(zhuān)門(mén)的立法對(duì)其加以規(guī)制,總是援引相關(guān)的法律法規(guī),但是這些法規(guī)并不能明確界定是否是侵權(quán)行為,在司法實(shí)踐中法官也沒(méi)有一個(gè)明確的判案依據(jù),導(dǎo)致微博侵權(quán)法律適用陷入一個(gè)尷尬的境地。這種情況下,我們應(yīng)該如何尋找出路?面對(duì)此種局面,筆者嘗試嘗試由淺入深,逐步展開(kāi)對(duì)微博名譽(yù)權(quán)保護(hù)的討論。論文第一章為緒論部分,主要介紹了論文研究的背景及意義、國(guó)內(nèi)外文獻(xiàn)綜述、主要研究?jī)?nèi)容和創(chuàng)新點(diǎn)等。第二章從一個(gè)案例著手,引出一些個(gè)人見(jiàn)解。第三章對(duì)微博名譽(yù)權(quán)一些基本的問(wèn)題進(jìn)行討論,為后文的研究提供了鋪墊,同時(shí)還探討了微博名譽(yù)侵權(quán)的諸多原因等。第四章詳細(xì)地分析論證了微博名譽(yù)侵權(quán)的責(zé)任認(rèn)定與承擔(dān)等問(wèn)題。第五章重點(diǎn)對(duì)比國(guó)內(nèi)外微博名譽(yù)侵權(quán)的立法規(guī)制,細(xì)致分析了適用于傳統(tǒng)意義的名譽(yù)侵權(quán)行為的法律不適用微博侵權(quán)的尷尬局面。最后,借鑒國(guó)外關(guān)于微博名譽(yù)權(quán)保護(hù)的一些相關(guān)立法和理論,進(jìn)而提出對(duì)我國(guó)微博名譽(yù)侵權(quán)保護(hù)的完善。
[Abstract]:Compared with the traditional right of reputation, the right of reputation of Weibo is not new, there is no substantial difference between them. With the Internet as the carrier, Weibo has the characteristics of fast spreading speed and wide range of influence. At the same time, it also brings the convenience of infringement. In recent years, Weibo reputation infringement cases emerge in endlessly. In the application of the law, there is no special legislation to regulate it, and the relevant laws and regulations are always invoked. However, these laws and regulations can not clearly define whether it is an act of infringement, nor does the judge have a clear basis for adjudicating a case in judicial practice. As a result, Weibo tort law application into an awkward situation. Under such circumstances, how should we find a way out? Facing this situation, the author tries to discuss the protection of Weibo reputation from shallow to deep. The first chapter is the introduction, which mainly introduces the background and significance of the research, the literature review at home and abroad, the main research content and innovation. The second chapter starts with a case and leads to some personal opinions. The third chapter discusses some basic issues of Weibo right of reputation, which provides the foundation for the later research, and also discusses the reasons of Weibo reputation infringement. The fourth chapter analyzes and demonstrates the responsibility of Weibo reputation infringement in detail. The fifth chapter focuses on the comparison of domestic and foreign Weibo reputation infringement legislation regulations, carefully analyzes the traditional meaning of reputation tort law does not apply to Weibo tort embarrassing situation. At last, we draw lessons from some relevant legislation and theories about the protection of Weibo reputation right in foreign countries, and then put forward the perfection of the protection of Weibo reputation infringement in our country.
