【摘要】:我國已經(jīng)正式步入老齡化社會,養(yǎng)老問題是一個嚴峻的社會問題,是創(chuàng)建和諧社會無法避免、必須面對的挑戰(zhàn)。開拓發(fā)展新型的養(yǎng)老模式變得十分必要。通過以房養(yǎng)老第三方抵押貸款合同來解決有房屋產(chǎn)權的老年人養(yǎng)老問題具有一定的可行性,其代表是津工超市的“養(yǎng)老幸福樹”項目。該項目開展的比較成功,具有很強的實踐意義。有必要從以房養(yǎng)老第三方抵押貸款合同的視角進行探討,探究合同各方當事人主體的權利和義務關系。本文主要采用比較和邏輯分析兩種方法,從以房養(yǎng)老第三方抵押貸款合同的含義入手,闡述該合同具有抵押方的特定性、房屋所有權和居住權的存續(xù)性、房屋剩余交換價值的穩(wěn)定性等特征。進一步辨析了該合同與以房養(yǎng)老反向抵押貸款合同的不同之處。通過借鑒其他國家關于以房養(yǎng)老業(yè)務的相關規(guī)定,結合我國老年人的現(xiàn)狀,界定以房養(yǎng)老第三方抵押貸款合同的抵押方為具有民事行為能力、擁有相應產(chǎn)權的房屋且年齡達到65歲及以上的老年人;借款方需要達到在中國大陸經(jīng)營時間超過5年、具有良好的償債能力等條件。貸款方則為國有商業(yè)銀行。在該合同中,借款方主要享有知情權和任意解除權,同時承擔告知義務、合理使用房屋的義務以及繳納相關費用義務。借款方主要享有合理使用貸款的權利,承擔信息披露義務和保證義務,同時需要提供養(yǎng)老服務。貸款方享有抵押權,承擔信息披露義務、協(xié)助義務和告知義務。通過對權利義務的相關理論剖析,以期周到地保護以房養(yǎng)老第三方抵押貸款合同各方主體的正當權益。
[Abstract]:Our country has formally stepped into the aging society, the pension problem is a severe social problem, is the inevitable challenge to build a harmonious society, must face. It is necessary to develop a new pension model. It is feasible to solve the problem of old-age pension with housing property right by means of the third party mortgage loan contract of housing for the aged, which is represented by the project of "endowment happiness tree" in Tianjin Gong supermarket. The project has been carried out successfully and has strong practical significance. It is necessary to probe into the relationship between the rights and obligations of the parties to the contract from the perspective of the third party mortgage contract. This paper mainly adopts two methods of comparison and logic analysis, starting with the meaning of the third party mortgage loan contract for the housing for the aged, expounds that the contract has the particularity of the mortgagor, the existence of the house ownership and the right of residence. The stability of the house surplus exchange value and so on. The difference between the contract and the reverse mortgage loan contract is further analyzed. By drawing lessons from the relevant provisions of other countries on the housing old-age care business, combined with the current situation of the elderly in China, define the mortgagor of the third party mortgage contract of housing endowment as the civil capacity. Those who have the corresponding property right and are 65 years old and above, the borrowers need to have more than five years of operation in mainland China, and have good solvency and other conditions. The lenders are state-owned commercial banks. In this contract, the borrower mainly enjoys the right to know and the right to be discharged at will, and at the same time undertakes the obligation of informing, the obligation to use the house reasonably and the obligation to pay the related expenses. The borrower mainly enjoys the right to use the loan reasonably, undertakes the obligation of information disclosure and guarantee, and needs to provide old-age service. The lender shall enjoy the mortgage and undertake the obligation to disclose information, assist and inform. Through the theoretical analysis of the rights and obligations, the author hopes to protect the legitimate rights and interests of the parties to the third party mortgage contract.
