【摘要】："金融消費者"概念隨著金融領域產(chǎn)品和服務日益復雜化而被倡導和推崇,尤以學術界為甚,實務界也順勢緊隨。以理論與實踐雙重坐標系檢驗,消費者法、金融業(yè)規(guī)范性文件、金融業(yè)發(fā)展與金融消費者概念創(chuàng)設等幾者并不匹配�；貧w到解釋論,金融領域消費者屬于消費者的子概念,意欲另外創(chuàng)設一個特定的"金融消費者"概念似乎意義并不顯著,忽視消費者法自身教義學體系,只會造成概念之間界限不清晰以及增加思維負擔,對學術研究和制度發(fā)展無益。金融消費者在中國法體系內(nèi)能且僅能被視為一種基于解釋論而產(chǎn)生的籠統(tǒng)稱謂。
[Abstract]:With the increasing complexity of financial products and services, the concept of "financial consumer" has been advocated and respected, especially in academic circles, and in practice. The double coordinate system test of theory and practice, consumer law, financial industry normative documents, financial industry development and financial consumer concept are not matched. Returning to the theory of interpretation, consumers in the financial field belong to the sub-concept of consumers, and the intention to create a specific concept of "financial consumers" does not seem significant, ignoring the doctrinal system of consumer law itself. It will only lead to unclear boundaries between concepts and increase the burden of thinking, which is not conducive to academic research and institutional development. Financial consumers can and can only be regarded as a general appellation based on interpretation theory in Chinese legal system.
