實用藝術(shù)作品著作權(quán)保護(hù)研究

【摘要】:我國實用藝術(shù)作品有著深厚的底蘊(yùn)和廣闊的土壤,其兼具實用性和藝術(shù)性的特征使其在當(dāng)今社會備受青睞。然而,實用藝術(shù)作品創(chuàng)作者的權(quán)利屢屢被侵犯卻難以被法律保障的問題不容忽視,現(xiàn)實的需求、立法的缺失和司法的困境等都昭示著賦予其著作權(quán)保護(hù)勢在必行。本文以實用藝術(shù)作品基本問題的分析為起點,比較世界范圍內(nèi)相關(guān)立法例對該類作品之規(guī)定的異同,在此基礎(chǔ)上結(jié)合我國相關(guān)的立法沿革與保護(hù)現(xiàn)狀,試圖明確實用藝術(shù)作品的構(gòu)成要件與保護(hù)模式,并對當(dāng)前相關(guān)立法修改提出合理化建議,以期為司法實踐中實用藝術(shù)作品侵權(quán)糾紛的判定與解決提供借鑒與指引。本文的結(jié)構(gòu)如下:第一章是對實用藝術(shù)作品著作權(quán)保護(hù)的基本問題的研究。首先根據(jù)各國際公約對其的概念界定,順理成章地得出,實用藝術(shù)作品首先必須構(gòu)成作品,并同時具備實用性和藝術(shù)性兩項特性。然后對與之相近似、易混淆的幾個概念進(jìn)行了辨析界分,以期準(zhǔn)確把握實用藝術(shù)作品的概念界定與特征,為探討其構(gòu)成要件做鋪墊。第二章是對實用藝術(shù)作品著作權(quán)保護(hù)的比較法研究。首先細(xì)述各個著作權(quán)相關(guān)的國際公約對實用藝術(shù)作品的規(guī)定,分析其背景、沿革與現(xiàn)狀,然后分析考察美國、德國、英國、法國等外國法律對該類作品的保護(hù)模式,綜合上述各國之相關(guān)規(guī)定,為下文提出我國相關(guān)立法完善建議做鋪墊。第三章是對實用藝術(shù)作品著作權(quán)保護(hù)要件的分析探討。通過梳理近年來我國司法實踐中出現(xiàn)的該類作品著作權(quán)糾紛案件,分析類似的諸多案例在判決理由與最終的判決結(jié)果上存在差異的原因,得出我國絕大部分相關(guān)案例的爭議焦點都是或者都包括涉案作品是否構(gòu)成實用藝術(shù)作品這一問題的結(jié)論。研究探討并總結(jié)歸納出符合“實用藝術(shù)作品獨創(chuàng)性程度要求”以及“實用功能與藝術(shù)美感可分離”這兩個構(gòu)成要件,作為實用藝術(shù)作品的判定標(biāo)準(zhǔn),為司法實踐中處理該類案件時解決此關(guān)鍵性前提問題提供有益借鑒。第四章是對我國實用藝術(shù)作品著作權(quán)保護(hù)的沿革與現(xiàn)狀的評述。首先詳述我國關(guān)于此類作品的立法沿革、實務(wù)及學(xué)理沿革;然后分析我國法律對此類作品的保護(hù)現(xiàn)狀,涉及現(xiàn)行《著作權(quán)法》及現(xiàn)行的其他法律法規(guī),以及《著作權(quán)法》第三次修改的各稿草案的相關(guān)規(guī)定;最后,通過對我國立法保護(hù)現(xiàn)狀的梳理與分析,總結(jié)歸納出其立法缺失。第五章是對我國實用藝術(shù)作品著作權(quán)保護(hù)的完善建議。首先,通過對于在立法之初未予保護(hù)的原因,以及由此直接導(dǎo)致的理論認(rèn)識誤區(qū)與司法實踐困境的分析,明確我國在立法修法中對實用藝術(shù)作品予以明確規(guī)定的必要性。然后,針對立法不足與缺失,提出我國此類作品著作權(quán)保護(hù)的完善建議。
[Abstract]:The practical works of art in our country have deep inside information and broad soil, and their characteristics of both practicality and artistry make them very popular in today's society. However, the problem that the rights of the creators of practical works of art are often infringed but difficult to be protected by the law can not be ignored. The realistic demand, the lack of legislation and the dilemma of the judicature all indicate that it is imperative to give the copyright protection to the authors. Based on the analysis of the basic problems of practical works of art, this paper compares the similarities and differences between the relevant legislation cases in the world and the provisions of this kind of works. On this basis, it combines the current situation of legislation evolution and protection in China. This paper attempts to clarify the constitutive elements and protection models of practical works of art, and puts forward some reasonable suggestions for the revision of relevant legislation, in order to provide reference and guidance for the judgment and resolution of tort disputes of practical works of art in judicial practice. The structure of this paper is as follows: the first chapter is about the basic problems of copyright protection of practical works of art. Firstly, according to the definition of international conventions, it is concluded that the works of practical art must first be composed of works, and have two characteristics of practicality and artistry at the same time. Then the author distinguishes and classifies several concepts which are similar and easily confused in order to accurately grasp the definition and characteristics of practical works of art and pave the way for the discussion of their constituent elements. The second chapter is a comparative study on the copyright protection of practical works of art. First of all, it details the provisions of various international conventions related to copyright on the work of practical art, analyzes its background, evolution and current situation, and then analyzes and examines the mode of protection of such works under foreign laws such as the United States, Germany, the United Kingdom, France, and so on. Synthesizing the relevant provisions of the above countries, this paper provides the following suggestions for the improvement of the relevant legislation of our country. The third chapter is the analysis of the elements of copyright protection of practical works of art. Through combing the copyright dispute cases of this kind of works in the judicial practice of our country in recent years, this paper analyzes the reasons for the differences between the reasons of judgment and the final judgment results in many similar cases. It comes to the conclusion that most of the relevant cases in China focus on whether or not the works involved constitute a practical work of art. This paper discusses and sums up the two constitutive requirements of "the originality of practical works of art" and "the separation of practical functions and aesthetic feeling of art", which are regarded as the criteria for judging practical works of art. It provides a useful reference for solving this critical premise problem in judicial practice. The fourth chapter reviews the history and present situation of copyright protection of practical works of art in China. First of all, the legislative evolution, practice and academic evolution of this kind of works are described in detail, and then the current situation of the protection of such works by Chinese law is analyzed, which involves the current copyright Law and other existing laws and regulations. And the relevant provisions of the third revised draft of copyright Law; finally, through the analysis of the current situation of legislative protection in China, summed up the lack of legislation. The fifth chapter is the perfect suggestion to our country practical art work copyright protection. First of all, through the analysis of the reasons why the legislation was not protected at the beginning of the legislation, the misunderstanding of theory and the dilemma of judicial practice, it is clear that it is necessary for our country to clearly stipulate the practical works of art in the legislative amendment law. Then, in view of the lack of legislation, this paper puts forward some suggestions for the copyright protection of this kind of works.
