【摘要】：對(duì)個(gè)人信息自主性的保障已經(jīng)成為當(dāng)今社會(huì)的主流思想,因?yàn)槿绱朔侥苷嬲Ｕ蟼�(gè)人的正常生活。隱私權(quán)正是在這樣的理念下逐漸發(fā)展并受到社會(huì)廣泛認(rèn)同的。個(gè)人不受他人的干擾,可以決定誰擁有權(quán)利獲知自己的某些私人信息,這是每個(gè)人自主權(quán)得到尊重的基本理念。但數(shù)字化記憶的可訪問性、持久性、全面性以及由此所帶來的"凝視"給人類帶來了嚴(yán)重挑戰(zhàn),人類日常生活面臨數(shù)字化時(shí)間與空間雙重維度的介入,這種介入導(dǎo)致了隱私不保時(shí)代的真正來臨。"被遺忘權(quán)"的提出雖然在一定程度上為化解這樣的數(shù)字異化提供了一種解決之道,但仍然存在較大的漏洞。
[Abstract]:The protection of the autonomy of personal information has become the mainstream of the society, because it can really protect the normal life of individuals. The right to privacy develops gradually under this concept and is widely recognized by the society. It is the basic idea that the individual can decide who has the right to know some of his personal information without interference from others, which is the basic idea that everyone's autonomy is respected. However, the accessibility, durability, comprehensiveness of digital memory and the "gaze" brought about by it have brought serious challenges to human beings. Human daily life is confronted with the involvement of digital time and space. This intervention has led to the real advent of an era of privacy insecurity. " The right to be forgotten provides a solution to this kind of digital alienation to a certain extent, but it still has a big loophole.
