【摘要】：無論學界還是司法實務界,對環(huán)境侵權因果關系的認識都存在不少混亂之處。一方面無法用傳統(tǒng)的充分或必要條件原因解釋環(huán)境侵權中因果關系的性質,而對能夠解釋環(huán)境侵權因果關系性質的部分因果關系理論又缺乏深入研究。另一方面,對判斷環(huán)境侵權因果關系的理論或方法的適用范圍缺少系統(tǒng)的分析,諸多理論或方法之間的關系并不十分清楚。把INUS條件因果關系理論應用在對環(huán)境侵權因果關系性質的分析上,并通過對原因行為與污染物之間因果關系的INUS最小充分條件集,以及污染物與損害結果之間因果關系的INUS最小充分條件集的研究,不但可以揭示環(huán)境侵權因果關系的本質,還能夠清晰顯示環(huán)境侵權因果關系諸理論或方法在判斷因果關系的過程中所處的解題位置。
[Abstract]:There is a lot of confusion in understanding the causality of environmental tort in both academic circles and judicial practice. On the one hand, the nature of causality in environmental tort can not be explained by traditional sufficient or necessary reasons, and the theory of partial causality which can explain the nature of environmental tort is lack of in-depth study. On the other hand, there is a lack of systematic analysis on the scope of application of the theory or method to judge the causality of environmental tort, and the relationship between many theories or methods is not very clear. The theory of INUS conditional causality is applied to the analysis of the nature of causality in environmental tort, and the INUS minimum sufficient condition set of causality between causation and pollution is given. And the study of the INUS minimum sufficient condition set of causality relationship between pollutant and damage result can not only reveal the essence of causality of environmental tort. It can also clearly show the position of causality theory or method of environmental tort in the process of judging causality.
