【摘要】：清潔能源技術(shù)作為應(yīng)對(duì)氣候變化的關(guān)鍵,國(guó)際公約中規(guī)定發(fā)達(dá)國(guó)家承擔(dān)向發(fā)展中國(guó)家轉(zhuǎn)移該技術(shù)的義務(wù)。即使國(guó)際條約對(duì)清潔能源技術(shù)轉(zhuǎn)移進(jìn)行了規(guī)定,但是現(xiàn)實(shí)的技術(shù)轉(zhuǎn)移效果不是很明顯。我國(guó)作為發(fā)展中國(guó)家,在環(huán)境問(wèn)題日益嚴(yán)峻的情況下,對(duì)清潔能源技術(shù)的需求顯得尤為迫切,但是清潔能源轉(zhuǎn)移過(guò)程中隱性知識(shí)的轉(zhuǎn)移是決定技術(shù)轉(zhuǎn)移的關(guān)鍵因素。為了積極響應(yīng)國(guó)際條約的號(hào)召,也為了完善我國(guó)對(duì)清潔能源技術(shù)轉(zhuǎn)移中隱性知識(shí)轉(zhuǎn)移的法律規(guī)定,本文立足于知識(shí)產(chǎn)權(quán)法,對(duì)清潔能源技術(shù)中隱性知識(shí)轉(zhuǎn)移進(jìn)行研究。本文首先厘清清潔能源、清潔能源技術(shù)及隱性知識(shí)等相關(guān)概念,從主要研究隱性知識(shí)本身的性質(zhì)過(guò)渡到研究隱性知識(shí)顯性化的問(wèn)題,進(jìn)而深入地研究隱性知識(shí)及其顯性化過(guò)程,同時(shí)還研究包括隱性知識(shí)和顯性知識(shí)的異同、隱性知識(shí)編碼化的可能性、轉(zhuǎn)移方式的選擇性以及其他影響轉(zhuǎn)移的因素,并且進(jìn)一步的闡述隱性知識(shí)轉(zhuǎn)移的重要性,自然的過(guò)渡到我國(guó)目前對(duì)清潔能源技術(shù)中隱性知識(shí)轉(zhuǎn)移的知識(shí)產(chǎn)權(quán)法保護(hù)現(xiàn)狀。本文從專(zhuān)利法、商業(yè)秘密保護(hù)以及反壟斷法的角度對(duì)清潔能源中隱性知識(shí)的轉(zhuǎn)移提出法律完善建議,并和發(fā)達(dá)國(guó)家的知識(shí)產(chǎn)權(quán)應(yīng)對(duì)進(jìn)行分析比較,提出我國(guó)的清潔能源知識(shí)產(chǎn)權(quán)應(yīng)對(duì)方案,希望為我國(guó)清潔能源技術(shù)更好的轉(zhuǎn)移、吸收、消化以及利用做出貢獻(xiàn)。
[Abstract]:Clean energy technology is the key to combat climate change. The developed countries undertake the obligation to transfer the technology to developing countries. Even though international treaties regulate the transfer of clean energy technologies, the actual effect of technology transfer is not obvious. As a developing country, the demand for clean energy technology is more and more urgent, but the transfer of tacit knowledge in the process of clean energy transfer is the key factor to determine the technology transfer. In order to respond positively to the call of international treaties, and to perfect the legal provisions of tacit knowledge transfer in clean energy technology transfer in China, this paper is based on intellectual property law to study the tacit knowledge transfer in clean energy technology. This paper first clarifies the related concepts of clean energy, clean energy technology and tacit knowledge, from mainly studying the nature of tacit knowledge to studying the problem of tacit knowledge dominance, and then deeply studying tacit knowledge and its dominance process. At the same time, it also studies the similarities and differences between tacit knowledge and explicit knowledge, the possibility of encoding tacit knowledge, the selectivity of transfer mode and other factors influencing transfer, and further expounds the importance of tacit knowledge transfer. Natural transition to the current situation of intellectual property protection of tacit knowledge transfer in clean energy technology in China. In this paper, from the point of view of patent law, trade secret protection and antimonopoly law, the author puts forward some legal suggestions on the transfer of tacit knowledge in clean energy, and analyzes and compares with the intellectual property rights of developed countries. In order to contribute to the transfer, absorption, digestion and utilization of clean energy technology in China, this paper puts forward a plan to deal with the intellectual property rights of clean energy in China.
