【摘要】：違反保護他人法律的侵權(quán)責任條款能為公法與侵權(quán)法的交匯融合提供轉(zhuǎn)介平臺。設(shè)置該侵權(quán)責任條款的核心價值在于其能實現(xiàn)對絕對權(quán)和利益的區(qū)分保護�！肚謾�(quán)責任法》第6條第1款存在"隱藏漏洞",應(yīng)當運用目的性限縮解釋進行漏洞填補,以確立區(qū)分保護絕對權(quán)和利益的正當性。保護他人法律須蘊含保護個人利益的立法目的,其認定最終要落腳于具體的法律條款。在法規(guī)目的理論的節(jié)制下,違反保護他人法律的侵權(quán)責任條款對絕對權(quán)的保護趨于保守,對利益的保護則顯得開放。因此,在民法典分則侵權(quán)責任編的制定過程中,有必要設(shè)計違反保護他人法律的侵權(quán)責任條款。
[Abstract]:The tort liability clause which violates the law of protection of others can provide a referral platform for the intersection of public law and tort law. The core value of setting up the tort liability clause is that it can realize the differential protection of absolute rights and interests. Article 6, paragraph 1, of the Tort liability Law has a "hidden loophole", which should be filled by a purposive constriction interpretation. In order to establish the distinction between the protection of absolute rights and interests of the legitimacy. The law of protecting others must contain the legislative purpose of protecting personal interests, and its determination should finally be based on specific legal provisions. Under the restraint of the theory of legal purpose, the protection of absolute right by tort liability clause which violates the law of protecting others tends to be conservative, and the protection of interests is open. Therefore, it is necessary to design tort liability clauses that violate the law of protecting others.
