論瑕疵業(yè)主大會決議之效力

【摘要】:我國社區(qū)早期傳統(tǒng)形態(tài)鮮有討論機(jī)制,而現(xiàn)在,公寓大廈、封閉小區(qū)已經(jīng)成為居住之主流。業(yè)主大會決議,對于落實業(yè)主自治制度,更好地管理自身居住環(huán)境,決定自己生活方式,意義重大。因而,建構(gòu)業(yè)主大會決議的效力規(guī)則十分必要。雖然我國現(xiàn)行《物權(quán)法》第78條對業(yè)主大會決議的撤銷有所規(guī)定,但由于條文過于簡單,制度尚顯單薄。本文擬通過引入相關(guān)案例與存在的問題,通過對業(yè)主大會決議之性質(zhì)進(jìn)行界定,進(jìn)而厘清業(yè)主大會決議之效力規(guī)則,并以求有所裨益。本文分四個部分來研究瑕疵業(yè)主大會決議的效力。第一部分通過介紹業(yè)主大會決議制度設(shè)計存在的漏洞以及一則案例引出的相關(guān)爭議,引出瑕疵業(yè)主大會決議效力研究的意義與本文的研究目的。第二部分探討了業(yè)主大會決議的性質(zhì)。通過對幾種學(xué)說的梳理與評析,分析論證了業(yè)主大會決議為多方法律行為。第三部分通過對業(yè)主大會決議具體瑕疵類型出發(fā),論證不同之瑕疵類型對決議效力的不同影響以及效力認(rèn)定的考量。第四部分是對文章內(nèi)容的總結(jié)與之前問題的回答。
[Abstract]:There are few discussion mechanisms in the early traditional form of community in China, but now, apartment buildings and closed residential areas have become the mainstream of housing. The resolution of the owners' Congress is of great significance to the implementation of the owners' autonomy system, the better management of their living environment and the determination of their own way of life. Therefore, it is necessary to construct the effective rules of the owners'meeting resolution. Although Article 78 of the present Real right Law of our country provides for the revocation of the resolution of the owners' Congress, the provisions are too simple and the system is still weak. By introducing the relevant cases and existing problems, this paper defines the nature of the resolution of the owners' meeting, and then clarifies the rules of validity of the resolution of the owners' meeting, in order to be of benefit. This paper is divided into four parts to study the validity of the resolution of the defective owners' meeting. The first part introduces the loopholes in the design of the resolution system of the owners' Congress and the relevant disputes arising from a case, which leads to the significance of the research on the validity of the resolution of the defective owners' Congress and the purpose of this paper. The second part discusses the nature of the resolution. Through combing and analyzing several kinds of theories, this paper analyzes and proves that the resolution of the owners' Congress is a multi-party legal act. The third part demonstrates the different effects of different types of defects on the validity of the resolution and the consideration of the validity of the resolution. The fourth part is the summary of the content of the article and the answers to the previous questions.
