【摘要】:民間文學(xué)藝術(shù)作品的產(chǎn)生需要一個(gè)國家或地區(qū)的人們擁有富足的物質(zhì)生活條件與深厚的生活情感。疆域之廣闊、歷史之悠久、人文情懷之深厚以及經(jīng)濟(jì)之逐步發(fā)達(dá),決定了我國有著富饒的民間文學(xué)藝術(shù)作品資源。隨著信息溝通便利程度的提高,越來越多的中華民間文學(xué)藝術(shù)作品走入人們的視野,其特有魅力使它創(chuàng)造出了不少于現(xiàn)代作品的經(jīng)濟(jì)價(jià)值。于是,商人對其進(jìn)行商業(yè)利用,索取其價(jià)值;創(chuàng)作者直接用其冠己之名出版發(fā)行賺取稿酬;有的甚至被國外行為藝術(shù)家以獵奇歪曲的方式展出并依此獲取名聲與金錢。這些現(xiàn)象的發(fā)生,對民間文學(xué)藝術(shù)作品所有人造成了精神損害,對民間文學(xué)藝術(shù)作品本身也是一種破壞,而法律的缺失導(dǎo)致這些行為無法管控。從中獲益者不僅未將通過這些行為所獲取的經(jīng)濟(jì)利益分享于民間文學(xué)藝術(shù)作品的所有人,而且也未將其所獲利益用于民間文學(xué)藝術(shù)作品的傳承與發(fā)展。鑒于公法保護(hù)不能直接惠及于民間文學(xué)藝術(shù)作品所有人,而民間文藝術(shù)作品所有人又是民間文學(xué)藝術(shù)作品傳承與發(fā)展的關(guān)鍵,故唯有賦予民間文學(xué)藝術(shù)作品所有人以私權(quán)并予以保護(hù),才能直接規(guī)制上述不當(dāng)行為,以保護(hù)民間文學(xué)藝術(shù)作品及其所有人的持有地位。全文共分五個(gè)部分。緒論部分簡要概括了此課題研究的選題背景及意義,對相關(guān)研究進(jìn)行了綜述,介紹了課題研究的主要內(nèi)容和研究方法。第一章,民間文學(xué)藝術(shù)作品及其保護(hù)的價(jià)值。首先梳理并分析了有關(guān)民間文學(xué)藝術(shù)的法律文件與民族學(xué)等相關(guān)學(xué)科對民間文學(xué)藝術(shù)作品涵義的界定和特征的描述,通過對分析結(jié)果的限定,明確了本文研究的民間文學(xué)藝術(shù)作品的具體指向;其次,在對民間文學(xué)藝術(shù)作品所有人的權(quán)利期望進(jìn)行分析的基礎(chǔ)上,論證了民間文學(xué)藝術(shù)作品保護(hù)的經(jīng)濟(jì)價(jià)值與其他價(jià)值,基于其當(dāng)前面臨的威脅,明確指出其應(yīng)受到著作權(quán)的保護(hù)。第二章,民間文學(xué)藝術(shù)作品著作權(quán)保護(hù)的理論困惑與法律缺失。一是通過對學(xué)界觀點(diǎn)與主張的梳理,分析了民間文學(xué)藝術(shù)作品未能納入著作權(quán)保護(hù)的原因,即基于對民間文學(xué)藝術(shù)作品定義、特征的含混表達(dá),導(dǎo)致其與一般著作權(quán)法理論之間的矛盾;二是對現(xiàn)有國內(nèi)外法律文件對其著作權(quán)保護(hù)的不完善性逐一進(jìn)行了評析;三是對由此不完善性在學(xué)界引發(fā)的諸多非著作權(quán)保護(hù)模式的局限性進(jìn)行解析。第三章,民間文學(xué)藝術(shù)作品著作權(quán)法律保護(hù)的理論解答。通過法社會(huì)學(xué)理論與著作權(quán)起源的分析,針對民間文學(xué)藝術(shù)作品著作權(quán)法律保護(hù)的必然性與合理性、主客體構(gòu)造、保護(hù)期限,以及保護(hù)的目的與權(quán)利性質(zhì)等理論困惑等,分別進(jìn)行了解答,并對現(xiàn)行的著作權(quán)制度進(jìn)行了反思。第四章,民間文學(xué)藝術(shù)作品著作權(quán)法律保護(hù)制度建構(gòu)。通過對矛盾與困惑的化解,以及民間文學(xué)藝術(shù)作品與現(xiàn)代文學(xué)藝術(shù)作品的差異,提出不能將民間文學(xué)藝術(shù)作品完全置于現(xiàn)行著作權(quán)法律保護(hù)的觀點(diǎn),建議國務(wù)院盡快出臺(tái)《民間文學(xué)藝術(shù)作品著作權(quán)保護(hù)條例》,并對其保護(hù)原則及保護(hù)規(guī)則等內(nèi)容提出了自己的觀點(diǎn)。
[Abstract]:The production of folk literature and art needs the rich material living conditions and deep life emotions in a country or region. The vast territory, the long history, the profound humanistic feelings and the gradual development of the economy have determined the resources of rich folk arts and art works in our country. With the convenience of information communication As a result, more and more Chinese folk literature and art works have entered people's field of vision. Their unique charm makes it not less than the economic value of modern works. The occurrence of these phenomena is a spiritual damage to all the people of folk literature and art, and it is also a damage to the works of folk literature and art itself, and the lack of law leads to these actions that can not be controlled. The benefit is shared by all people in the works of folk literature and art, and it has not been used for the inheritance and development of the works of folk literature and art. In view of the fact that the protection of public law can not directly benefit all the people of the folk literature and art works, the people of the folk art works are the key to the inheritance and development of the literary and artistic works among the people. Only by endowing the folk literature and art works with the private rights and protection, can we directly regulate the above misconduct to protect the works of folk literature and art and the holding status of all the people. The full text is divided into five parts. The introduction briefly summarizes the background and significance of the topic research, summarizes the related research, and introduces the related research. First, by combing the views and opinions of the academic circles, the reasons for the failure of the folk literature and art works to be included in the protection of copyright are analyzed, which is based on the ambiguous expression of the definition of folk literature and art and the contradiction between the theory of the general copyright law. The two is to analyze the imperfection of the copyright protection of the existing domestic and foreign legal documents. The three is the analysis of the limitations of many non copyright protection modes caused by the imperfection in the academic circles. The third chapter, the theoretical solution of the legal protection of the copyright of the folk literature and art works. The analysis of the origin of rights, in view of the inevitability and rationality of the legal protection of the copyright of the folk literature and art works, the structure of the subject and object, the duration of protection, the theoretical puzzles of the protection and the nature of rights, and so on, and the reflection on the current copyright system, the fourth chapter, the legal protection of the copyright of the folk literature and art works. By dissolving the contradictions and puzzles, as well as the differences between the works of folk literature and art and the works of modern literature and art, it is suggested that the folk literature and art works can not be completely placed in the current legal protection of copyright, and the State Council is suggested to publish the Copyright Protection Ordinance of the folk literature art works as soon as possible and to protect it. And the protection rules put forward their own views.
