【摘要】：通過(guò)分析近年來(lái)58例學(xué)校體育運(yùn)動(dòng)傷害事故的司法判例發(fā)現(xiàn),同場(chǎng)對(duì)抗類項(xiàng)目發(fā)生運(yùn)動(dòng)傷害的幾率最高,運(yùn)動(dòng)傷害事故主要集中在初中階段,學(xué)校存在過(guò)錯(cuò)以及承擔(dān)賠償?shù)谋壤哂谄渌?zé)任主體。體育運(yùn)動(dòng)自身固有風(fēng)險(xiǎn)是中小學(xué)運(yùn)動(dòng)傷害事故發(fā)生的內(nèi)在因素,學(xué)校運(yùn)動(dòng)風(fēng)險(xiǎn)防控制度不健全、場(chǎng)地設(shè)施缺陷、教師未盡職履責(zé)、學(xué)生運(yùn)動(dòng)風(fēng)險(xiǎn)防控能力不足成為傷害事故發(fā)生的外在誘因。事故責(zé)任劃分適用過(guò)錯(cuò)責(zé)任原則,公平責(zé)任原則為事故經(jīng)濟(jì)損失的分擔(dān)作了有益補(bǔ)充。提出了15項(xiàng)學(xué)校運(yùn)動(dòng)風(fēng)險(xiǎn)防控措施,包括學(xué)校體育管理5項(xiàng)、體育課5項(xiàng)、課外體育活動(dòng)2項(xiàng)、課余體育訓(xùn)練與競(jìng)賽3項(xiàng)。
[Abstract]:By analyzing 58 cases of school sports injury accidents in recent years, it is found that sports injuries are most likely to occur in the same field confrontational events, and sports injury accidents are mainly concentrated in the junior middle school stage. The proportion of school fault and compensation is higher than that of other responsibility subjects. The inherent risk of sports itself is the inherent factor of sports injury accidents in primary and secondary schools. The school sports risk prevention and control system is not perfect, the site and facilities are defective, and teachers are not responsible for their duties. Students' insufficient ability to prevent and control sports risks has become the external cause of injury accidents. The principle of fault liability is applied to the division of accident liability, and the principle of fair liability complements the sharing of economic loss of accident. This paper puts forward 15 measures to prevent and control the risk of school sports, including 5 items of school sports management, 5 items of physical education, 2 items of extracurricular sports activities, 3 items of extracurricular sports training and competitions.
