商業(yè)方法的可專利性分析

【摘要】:長久以來,商業(yè)方法都被認為屬于智力活動的規(guī)則和方法而被排除在專利保護之外。隨著電子商務的迅猛發(fā)展,商業(yè)方法專利也同益引起人們的重視。自1998年美國開商業(yè)方法專利保護之大門,各國也開始調整自己的專利政策來應對蜂擁而至的商業(yè)方法專利申請。然而,美、日、歐等國政策上的變化并不能取代學界的爭論,更不能代表我國的態(tài)度。本文從商業(yè)方法專利的演進過程入手,介紹各國因應商業(yè)方法專利的政策變化,并分析商業(yè)方法專利的發(fā)展趨勢。在此基礎上,結合我國的現(xiàn)行專利法律制度,探討商業(yè)方法的可專利性,,進而提出我國在對待這一問題上所應采取的態(tài)度和對策,以期對相關立法和實踐有所裨益。
[Abstract]:Business methods have long been excluded from patent protection as rules and methods of intellectual activity. With the rapid development of e-commerce, the patent of business method also attracts people's attention. Since 1998, when the United States opened the door of business method patent protection, countries began to adjust their patent policies to deal with the influx of business process patent applications. However, the changes in the policies of the United States, Japan, Europe and other countries can not replace the academic debate, nor can they represent the attitude of our country. Starting with the evolution of business method patents, this paper introduces the policy changes of business method patents in various countries, and analyzes the development trend of business method patents. On this basis, combined with the current patent legal system of our country, the patentability of commercial methods is discussed, and the attitude and countermeasures that our country should take to deal with this problem are put forward in order to benefit the relevant legislation and practice.
