【摘要】："非誠(chéng)勿擾"商標(biāo)案提醒電視從業(yè)者,電視節(jié)目名稱與商標(biāo)權(quán)有可能產(chǎn)生沖突。沖突的根源在于文字的公共屬性與私權(quán)的排他性,動(dòng)因則是隨著電視文化產(chǎn)品的創(chuàng)新與商業(yè)模式的革新,節(jié)目性質(zhì)與注冊(cè)商標(biāo)核定服務(wù)類型的趨同以及節(jié)目名稱的使用構(gòu)成商標(biāo)法意義上的"使用"。為了促進(jìn)電視文化產(chǎn)業(yè)的發(fā)展,防止欄目名稱遭受商標(biāo)侵權(quán)糾紛,電視制作單位在在節(jié)目籌備階段,要警惕商標(biāo)陷阱;在發(fā)現(xiàn)商標(biāo)搶注時(shí),要積極提出異議與無效宣告;在被訴商標(biāo)侵權(quán)時(shí),要積極應(yīng)對(duì)訴訟。
[Abstract]:The "if you are the one" trademark reminds television operators that TV program names and trademark rights may conflict. The root of the conflict lies in the exclusiveness of the public attribute and private right of the text, and the reason is that with the innovation of the TV cultural products and the innovation of the business model, The convergence between the nature of the program and the approved service type of the registered trademark and the use of the program name constitute the "use" in the sense of trademark law. In order to promote the development of TV cultural industry and prevent the column name from being infringed by trademark infringement disputes, TV production units should be alert to trademark traps in the program preparation stage, and actively raise objections and invalidation declarations when trademark grabs are found. When being sued for trademark infringement, we should actively deal with the lawsuit.
