【摘要】：小產(chǎn)權(quán)房是中國二元土地制度中產(chǎn)生的特有現(xiàn)象,其因房價低廉而深受城市中的收入者的喜愛,但由于法律對農(nóng)村集體所有土地的流轉(zhuǎn)有嚴(yán)格限制,小產(chǎn)權(quán)房的買賣有許多法律風(fēng)險。農(nóng)村土地承載著中國14億人口的糧食安全問題,承載著龐大農(nóng)村人口的生活保障問題。小產(chǎn)權(quán)房應(yīng)否被取締,如何解決市場龐大但又存在社會隱患的小產(chǎn)權(quán)房成為了社會熱點。
[Abstract]:The small property right house is a special phenomenon in the dual land system of China. It is loved by the income people in the city because of the low house price, but because the law has the strict restriction to the circulation of the rural collective-owned land.There are many legal risks involved in the sale of small property houses.Rural land carries the food security problem of 1.4 billion people in China and the livelihood guarantee problem of large rural population.Whether the small property house should be banned, how to solve the huge market but there are social hidden dangers of small property house has become a social hot spot.
