我國(guó)民間借貸利率規(guī)制的法律問(wèn)題研究

【摘要】:以《最高人民法院關(guān)于人民法院審理借貸案件的若干意見(jiàn)》(以下簡(jiǎn)稱《意見(jiàn)》)第6條為中心的利率規(guī)制措施凸顯出我國(guó)對(duì)民間借貸利率濃厚的管控基調(diào)。時(shí)至今日,其運(yùn)行已有20余年。在市場(chǎng)經(jīng)濟(jì)的不斷發(fā)展以及利率市場(chǎng)化的大環(huán)境下,我國(guó)當(dāng)前的利率規(guī)制模式和利率上限的確定已不能滿足經(jīng)濟(jì)發(fā)展的現(xiàn)實(shí)需求,甚至帶來(lái)更多的負(fù)面影響,繼續(xù)使用難以達(dá)到預(yù)期的成效。利率是對(duì)民間借貸規(guī)制的起點(diǎn)1,也是考察民間借貸是否合法的關(guān)鍵因素。對(duì)民間借貸利率的規(guī)制程度決定了民間借貸的保護(hù)程度和發(fā)展方向。而民間借貸不僅僅是涉及當(dāng)事人之間的財(cái)產(chǎn)處分和意思自治問(wèn)題,更是涉及國(guó)家經(jīng)濟(jì)發(fā)展與安全、社會(huì)穩(wěn)定的公共問(wèn)題。因此,研究如何規(guī)制民間借貸利率顯得意義重大。本文共分為四個(gè)部分。第一部分是對(duì)民間借貸利率規(guī)制的基本概述。本部分首先對(duì)民間借貸的概念進(jìn)行界定;其次,闡述了民間借貸利率規(guī)制的內(nèi)涵;最后,介紹了我國(guó)民間借貸利率規(guī)制的基本做法,包括對(duì)我國(guó)當(dāng)前借貸利率特點(diǎn)的歸納以及規(guī)制民間借貸利率基本路徑的分析。第二部分論述了我國(guó)民間借貸利率規(guī)制的困境,包括規(guī)制民間借貸利率立法層面的困境、司法適用的困境。對(duì)立法層面困境以當(dāng)前學(xué)術(shù)界對(duì)民間借貸的主要爭(zhēng)議點(diǎn)出發(fā),包括現(xiàn)行規(guī)制民間借貸立法的不足、現(xiàn)行法律的相互沖突與矛盾、借貸利率上限的合理性問(wèn)題。司法適用層面,以具體的案例為切入點(diǎn),探討民間借貸的司法適用的幾點(diǎn)困境。包括司法實(shí)踐中借貸復(fù)利的適用、對(duì)違反法定利率上限的法律裁判標(biāo)準(zhǔn)、逾期利息無(wú)約定情形下的利率推定規(guī)則,通過(guò)分析比較得出自己的思考。第三部分是關(guān)于域外民間借貸利率規(guī)制的比較法考察與啟示。該部分選取美國(guó)、德國(guó)以及我國(guó)香港地區(qū)進(jìn)行考察和分析。在此基礎(chǔ)上總結(jié)了這些國(guó)家或地區(qū)的做法對(duì)我國(guó)的啟示,包括制定專門(mén)規(guī)制民間借貸立法、根據(jù)現(xiàn)實(shí)情況制定符合我國(guó)民間借貸發(fā)展的合理利率上限。第四部分,基于對(duì)我國(guó)當(dāng)前規(guī)制民間借貸利率法律的考察以及民間借貸現(xiàn)狀以及發(fā)展需求的思考,結(jié)合域外相關(guān)國(guó)家的經(jīng)驗(yàn)借鑒,對(duì)完善民間借貸利率的法律規(guī)制提出建議。包括完善民間借貸的法律規(guī)范、建立健全的民間借貸監(jiān)管機(jī)制、加強(qiáng)司法對(duì)民間借貸利率的規(guī)制以及建立規(guī)制民間借貸利率的配套制度。
[Abstract]:The interest rate regulation measures centered on Article 6 of the Supreme people's Court on the trial of loan cases by the people's Court (hereinafter referred to as "opinions") highlight the tone of our country's strong control over private lending rates.Today, its operation has been more than 20 years.With the continuous development of market economy and the marketization of interest rate, the current interest rate regulation model and the determination of interest rate cap in our country can no longer meet the actual needs of economic development, and even bring more negative effects.Continued use is difficult to achieve the desired results.Interest rate is the starting point of the regulation of private lending and also the key factor to investigate whether private lending is legal.The degree of regulation on private lending rate determines the protection and development direction of private lending.Private lending is not only related to the disposition of property and autonomy between the parties, but also to the national economic development and security, social stability of public issues.Therefore, the study on how to regulate private lending interest rates is of great significance.This paper is divided into four parts.The first part is the basic overview of private lending interest rate regulation.This part first defines the concept of private lending; secondly, expounds the connotation of the regulation of private lending interest rate; finally, introduces the basic methods of the regulation of private lending interest rate in China.Including the characteristics of the current lending rate in China and the regulation of the basic path of private lending rate analysis.The second part discusses the dilemma of the regulation of private lending interest rate in China, including the difficulty of regulating the private lending interest rate in the legislative level and the dilemma of judicial application.The main controversial points of the current academic circles on private lending include the deficiency of the current regulation of private lending legislation, the conflict and contradiction of the current laws, and the rationality of the upper limit of the lending interest rate.At the level of judicial application, this paper probes into the difficulties of the judicial application of private lending.It includes the application of compound interest of loan in judicial practice, the rule of presumption of interest rate under the circumstance of violating the legal judgment standard of legal interest limit and the case of overdue interest without agreement, and gets its own thinking through analysis and comparison.The third part is about the foreign private lending interest rate regulation of comparative law investigation and inspiration.This part selects the United States, Germany and our country Hong Kong area to carry on the inspection and the analysis.On this basis, this paper summarizes the enlightenment of these countries or regions to our country, including the enactment of special legislation to regulate private lending, and the establishment of a reasonable interest rate ceiling in line with the development of private lending in China according to the actual situation.The fourth part, based on the investigation of the current law of regulating the private lending interest rate, the current situation of private lending and the development needs of thinking, combined with the experience of relevant countries outside the country, to improve the legal regulation of private lending interest rate put forward suggestions.It includes perfecting the legal norms of private lending, establishing a sound supervision mechanism of private lending, strengthening the regulation of private lending interest rate by the judiciary and establishing a supporting system to regulate the private lending interest rate.
