【摘要】：現(xiàn)代社會中人類居住環(huán)境的變化,讓彼此間不相熟悉的人們在其所居住的小區(qū)里形成了一個(gè)地緣共同體。在這樣的居住環(huán)境下生活,時(shí)間久了人們常會因?qū)ξ飿I(yè)的管理和使用問題發(fā)生矛盾和糾紛,為了避免矛盾的擴(kuò)大化,建筑物區(qū)分所有權(quán)制度慢慢的從實(shí)踐中孕育而生,這么一來,生活在同一小區(qū)中的人就能以此制度為基礎(chǔ)成立業(yè)主自治組織,以自治的方式來解決小區(qū)物業(yè)管理上的糾紛。我國自《物權(quán)法》頒布后,也確立了建筑物區(qū)分所有權(quán)制度,但是物權(quán)法頒布至今,在小區(qū)生活和物業(yè)管理中所暴露出來的實(shí)際問題又告訴我們,以此制度為基礎(chǔ)的業(yè)主自治在我國小區(qū)生活中并沒真正的發(fā)揮起作用。造成這一結(jié)果的影響因素很多,但從積極的一面來看,這使得我國對研究業(yè)主自治問題有著緊迫的需求,為這一領(lǐng)域的完善提供了現(xiàn)實(shí)條件。論文首先分介紹了業(yè)主自治產(chǎn)生的理論淵源,業(yè)主自治的含義,解釋了業(yè)主、業(yè)主自治組織等相關(guān)概念;其次,闡述了我國業(yè)主自治現(xiàn)狀及存在的問題,并對存在的問題進(jìn)行分析;再次,是對業(yè)主自治過程中的幾類關(guān)系給予了厘清,為后續(xù)給出相應(yīng)的確保業(yè)主自治權(quán)的主張與實(shí)現(xiàn)的對策做了鋪墊;最后,提出了保障我國業(yè)主自治權(quán)實(shí)現(xiàn)的可行法律對策,即:對現(xiàn)階段業(yè)主自治組織的結(jié)構(gòu)進(jìn)行優(yōu)化,提出借鑒美國業(yè)主自治制度建立業(yè)主團(tuán)體,以業(yè)主團(tuán)體為中心對我國業(yè)主自治制度的運(yùn)作做進(jìn)一步的優(yōu)化。
[Abstract]:The change of human living environment in modern society makes people who are not familiar with each other form a geographical community in the community in which they live.Living in such a living environment, people often have contradictions and disputes because of the management and use of property for a long time. In order to avoid the expansion of contradictions, the system of building condominium is born slowly from practice.In this way, people living in the same community can set up owners' self-governing organization based on this system, and solve the disputes on property management in the way of autonomy.Since the promulgation of the Real right Law, China has also established the system of building division ownership. However, since the promulgation of the property Law, the actual problems exposed in the area life and property management have told us again.The owner autonomy based on this system has not really played a role in the community life in our country.There are many factors that influence this result, but on the positive side, there is an urgent need for the study of owner autonomy in our country, which provides a realistic condition for the perfection of this field.Firstly, the paper introduces the origin of the owner autonomy, the meaning of the owner autonomy, explains the related concepts such as the owner, the owner autonomy organization and so on. Secondly, it expounds the present situation and the existing problems of the owner autonomy in our country.And analyze the existing problems; thirdly, it clarifies several kinds of relationships in the process of owner autonomy, and paves the way for the following to ensure the owner autonomy and the realization of countermeasures; finally,This paper puts forward the feasible legal countermeasures to guarantee the realization of the owner's autonomy in our country, that is, to optimize the structure of the owner's self-governing organization at the present stage, and to set up the owner's group with reference to the American owner's autonomy system.Take the owner group as the center to make further optimization to the operation of the owner autonomy system in our country.
