【摘要】：本論文研究的是結(jié)建防空地下室的產(chǎn)權(quán)歸屬和利用維護(hù)責(zé)任分擔(dān)問題,主要從以下幾方面進(jìn)行研討:一是通過資料分析對比等方法,提煉出我國現(xiàn)階段的結(jié)建防空地下室建設(shè)已經(jīng)從要數(shù)量向要質(zhì)量轉(zhuǎn)變的觀點(diǎn),由此提出為何我們已無法回避結(jié)建防空地下室的權(quán)屬及利用維護(hù)問題;二是對現(xiàn)階段理論和實(shí)踐中結(jié)建防空地下室權(quán)屬問題的三種主流觀點(diǎn)進(jìn)行分析:即歸國家所有論、歸開發(fā)商所有論及歸業(yè)主所有論。本論文對比研究了每一種觀點(diǎn)背后的法律背景及現(xiàn)實(shí)影響,初步提出了本論文的法律研究框架;三是提出了結(jié)建防空地下室應(yīng)當(dāng)歸國家所有的方案。通過案例及法理分析等方法,解釋了為什么結(jié)建防空地下室歸國家所有更符合物權(quán)法精神,更適合我國現(xiàn)階段國情。此外,通過具體的實(shí)驗(yàn)結(jié)果,提出了如何在技術(shù)和政策層面實(shí)現(xiàn)由國家監(jiān)督,利用人和管理人具體開展結(jié)建防空地下室的維護(hù)和管理;四是在確定結(jié)建防空地下室歸屬之后,提出了政府部門該如何以公權(quán)力確保結(jié)建防空地下室的有效利用,尤其是如何落實(shí)其在使用中的維護(hù)管理機(jī)制,以保證結(jié)建防空地下室的防護(hù)功能不被破壞,最終達(dá)到本文研究的目的。本論文的主要意義在通過深入了解結(jié)建防空地下室的特性,提出我國結(jié)建防空地下室國家所有,在此基礎(chǔ)上以地方性法規(guī)為支點(diǎn),建立政府監(jiān)督,直接利用或管理人具體做好維護(hù)的管理模式,進(jìn)一步解決結(jié)建防空地下室的權(quán)屬和使用問題。
[Abstract]:This paper studies the ownership of property rights and the sharing of responsibility for utilizing and maintaining air defense basements, which are mainly discussed in the following aspects: first, through the analysis and comparison of data,This paper abstracts the view that the construction of junction air defense basement in our country has changed from the important quantity to the important quality at the present stage, and puts forward why we can not avoid the ownership and utilization and maintenance of the junction air defense basement.The second is to analyze the three main views of the ownership of air defense basement in theory and practice at the present stage: the theory of belonging to the state, the theory of ownership by the developer and the theory of ownership by the owner.This paper contrasts the legal background and realistic influence of each viewpoint, and puts forward the legal research frame of this paper preliminarily. Third, it puts forward the scheme that the air defense basement should be owned by the state.By means of case study and legal theory analysis, the author explains why it is more in line with the spirit of property law and is more suitable for the present situation of our country to build an air defense basement owned by the state.In addition, through the concrete experimental results, the paper puts forward how to realize the maintenance and management of the junction air defense basement by using the personnel and the manager at the technical and policy level. Fourth, after determining the ownership of the joint air defense basement,This paper puts forward how the government should use public power to ensure the effective use of the junction air defense basement, especially how to implement its maintenance management mechanism in use, so as to ensure that the protective function of the junction air defense basement is not destroyed.Finally, the purpose of this paper is achieved.The main significance of this paper is to find out the characteristics of the joint air defense basement, and put forward the national ownership of the joint air defense basement in our country. On this basis, the local laws and regulations are taken as the fulcrum, and the government supervision is established.The management mode of maintenance should be made use of directly or managed, and the ownership and use of air defense basement should be further solved.
