【摘要】：侵權(quán)法中的可預(yù)見性標(biāo)準(zhǔn)既體現(xiàn)了過錯(cuò)責(zé)任的一般思想,也體現(xiàn)了因果關(guān)系鏈合理切斷的需要。因此,可預(yù)見性規(guī)則可謂是融可歸責(zé)性與責(zé)任限制于一體的規(guī)則。盡管過失與近因的判斷都要考慮到預(yù)見性問題,但兩者的側(cè)重點(diǎn)不一樣,不能相互替代。在過失侵權(quán)中,后者是在前者判斷基礎(chǔ)上的進(jìn)一步細(xì)致化判斷。此外,預(yù)見性問題在過失與近因判斷中的重疊出現(xiàn),有助于反思侵權(quán)構(gòu)成要件的判斷流程。
[Abstract]:The predictability standard in tort law not only embodies the general idea of fault liability, but also reflects the need of reasonable cutting of causality chain.Therefore, predictability rules can be described as a combination of imputability and liability limitation.Although the judgment of fault and proximal cause should take into account the problem of foresight, the emphasis of both is different and cannot be replaced by each other.In the tort of negligence, the latter is a further detailed judgment on the basis of the former judgment.In addition, the overlap of foresight in fault judgment and proximate cause judgment is helpful to reflect on the judgment process of the constitutive elements of tort.
