【摘要】：監(jiān)護(hù)制度是人類(lèi)社會(huì)文明進(jìn)步的表現(xiàn),體現(xiàn)著國(guó)家對(duì)弱勢(shì)群體的人文關(guān)懷。隨著經(jīng)濟(jì)的迅猛發(fā)展,我國(guó)在政治、經(jīng)濟(jì)、文化等各種領(lǐng)域均發(fā)生了翻天覆地的變化。這些巨大的變化使得監(jiān)護(hù)制度滯后于當(dāng)今社會(huì)的發(fā)展,顯現(xiàn)出一系列問(wèn)題。特別是當(dāng)精神病人肇事的案件頻頻發(fā)生,人口老齡化問(wèn)題的日益嚴(yán)峻,在這個(gè)背景下,探討如何讓監(jiān)護(hù)制度更好地發(fā)揮保護(hù)這些弱勢(shì)群體的功能,是具有緊迫的現(xiàn)實(shí)意義的。雖然學(xué)術(shù)界對(duì)成人監(jiān)護(hù)問(wèn)題有了一定的研究成果。但筆者在概括、梳理前輩們觀點(diǎn)的同時(shí)提出了自己的觀點(diǎn)。本文的研究和寫(xiě)作主要運(yùn)用了歷史分析方法、比較分析方法、案例研究法和價(jià)值分析法。本文將圍繞成人監(jiān)護(hù)制度這一主題展開(kāi),共分為四個(gè)部分:第一部分是成人監(jiān)護(hù)制度的概述。這部分主要為監(jiān)護(hù)制度的深入探討奠定基礎(chǔ)。第二部分是外國(guó)成人監(jiān)護(hù)制度的發(fā)展。主要闡述它們?cè)诔扇吮O(jiān)護(hù)領(lǐng)域的立法理念、立法概況及在改革實(shí)踐中取得的成果,并予以總結(jié)、歸納得出啟示,為完善我國(guó)相關(guān)制度提供參考。第三部分是我國(guó)現(xiàn)行成人監(jiān)護(hù)制度的現(xiàn)狀及不足。筆者通過(guò)當(dāng)今社會(huì)中的典型案例,對(duì)我國(guó)現(xiàn)行的成人監(jiān)護(hù)制度進(jìn)行分析并揭示我國(guó)目前相關(guān)制度存在的一些缺陷。這將有助于為我國(guó)成人監(jiān)護(hù)制度的完善制定出針對(duì)性的措施。第四部分是我國(guó)成人監(jiān)護(hù)制度的構(gòu)建。我國(guó)現(xiàn)行的成人監(jiān)護(hù)制度應(yīng)當(dāng)在吸收現(xiàn)代監(jiān)護(hù)制度理念的基礎(chǔ)上選擇適合我國(guó)國(guó)情的制度框架體系。筆者針對(duì)第三部分論述的問(wèn)題,提出修改和完善建議。
[Abstract]:Guardianship system is the expression of civilization and progress of human society.With the rapid development of economy, great changes have taken place in politics, economy, culture and other fields.These great changes make the guardianship system lag behind the development of today's society, showing a series of problems.Especially when the cases caused by mental patients occur frequently and the problem of aging population becomes more and more serious, it is of urgent practical significance to explore how to make the guardianship system play a better role in protecting these vulnerable groups.Although the academic community has a certain degree of research on adult guardianship.However, the author summarized, combing the views of the predecessors at the same time put forward their own views.Historical analysis, comparative analysis, case study and value analysis are used in the research and writing of this paper.This paper will focus on the theme of adult guardianship system, divided into four parts: the first part is an overview of adult guardianship system.This part mainly lays the foundation for the further discussion of guardianship system.The second part is the development of foreign adult guardianship system.This paper mainly expounds their legislative ideas, general situation of legislation and achievements in reform practice in the field of adult guardianship, and summarizes them, and concludes the enlightenment, which provides a reference for perfecting the relevant system of our country.The third part is the current situation and deficiency of adult guardianship system in China.The author analyzes the current adult guardianship system of our country through typical cases in the present society and reveals some defects of the current relevant system in our country.This will contribute to the improvement of adult guardianship system in China to formulate targeted measures.The fourth part is the construction of adult guardianship system in China.The current adult guardianship system of our country should choose the system frame system suitable for our country's national conditions on the basis of absorbing the modern guardianship system idea.In view of the third part, the author puts forward some suggestions for modification and perfection.
