【摘要】：互聯(lián)網(wǎng)時代每個人都能參與信息的發(fā)布與傳遞,云計算和社會化媒體等技術(shù)促進(jìn)數(shù)據(jù)融通與共享,有必要完善相關(guān)法律規(guī)定來保護(hù)個人信息權(quán)。個人信息權(quán)與在其基礎(chǔ)上產(chǎn)生的財產(chǎn)權(quán)不同,人格屬性仍然是其本質(zhì)特征。我國個人信息保護(hù)宜采用"基本法+特殊法"的立法保護(hù)機(jī)制,在立法上應(yīng)當(dāng)確立個人信息權(quán)及其權(quán)利與義務(wù)的內(nèi)容;明確個人信息的保護(hù)范圍及其界定標(biāo)準(zhǔn),針對不同類型個人信息進(jìn)行分層保護(hù);采取有效救濟(jì)措施,切實(shí)保障個人信息權(quán);建立行業(yè)自律機(jī)制,完善配套制度。
[Abstract]:In the Internet era, everyone can participate in the dissemination and transmission of information, cloud computing and social media technologies to promote data fusion and sharing, It is necessary to improve the relevant laws and regulations to protect the right to personal information. The personality attribute is still its essential characteristic. In our country, we should adopt the legislative protection mechanism of "basic Law", and establish the content of personal information right and right and duty in legislation. Make clear the scope of personal information protection and its definition standards, for different types of personal information for hierarchical protection; take effective relief measures to effectively protect the right to personal information; establish a self-discipline industry mechanism, improve the supporting system.
