【摘要】：隨著自媒體時(shí)代的到來,觀眾在賽事觀看過程中對(duì)于賽事的轉(zhuǎn)播行為將對(duì)于依照轉(zhuǎn)播協(xié)議合法擁有轉(zhuǎn)播權(quán)的權(quán)利人產(chǎn)生消極影響。但是包括著作權(quán)法在內(nèi)的知識(shí)產(chǎn)權(quán)法由于沒有明確互聯(lián)網(wǎng)媒體的廣播組織法律地位,因而很難對(duì)于上述問題加以調(diào)整。司法實(shí)踐中賽事轉(zhuǎn)播權(quán)也未得到知識(shí)產(chǎn)權(quán)法律的完全保障。為了促進(jìn)體育市場(chǎng)的健康發(fā)展,需要通過法律的修訂和市場(chǎng)的有效監(jiān)管進(jìn)一步維護(hù)轉(zhuǎn)播協(xié)議當(dāng)事方的合法權(quán)益,同時(shí)在保護(hù)觀眾著作權(quán)合法權(quán)利的基礎(chǔ)上完善市場(chǎng)的自我調(diào)節(jié)機(jī)制。
[Abstract]:With the advent of the era of the media, The behavior of the audience during the watching of the event will have a negative impact on the rights holders who legally own the broadcasting rights in accordance with the relay agreement. However, the intellectual property law, including copyright law, is not clearly interconnected because of the lack of clear interconnection. The legal status of broadcasting organizations in the Internet media, Therefore, it is difficult to adjust the above problems. In judicial practice, the right to broadcast matches is not fully protected by intellectual property law. In order to promote the healthy development of the sports market, It is necessary to further protect the legitimate rights and interests of the parties to the relay agreement through the revision of the law and the effective supervision of the market, and at the same time perfect the self-regulating mechanism of the market on the basis of protecting the legitimate rights of the copyright of the audience.
