【摘要】：《民法總則》的通過和即將實施表明我國民法典的編纂邁出重要的一步�？偨Y《民法總則》中關于習慣的規(guī)范,對于理解《民法總則》、思考民法典編纂中有關習慣的科學安排有積極意義�！睹穹ǹ倓t》對習慣進行了直接的認可規(guī)定,確認了習慣法的正式法源地位。《民法總則》對習慣進行了隱含規(guī)定、吸納規(guī)定,體現(xiàn)了對我國民事生活內(nèi)生規(guī)范的尊重。同時,《民法總則》在有關習慣方面還存在空漏狀況,需要在編纂民法典、整體完成民法典時予以彌補和完善。在民法典分則編制定和民法典整體編纂時,需要認真總結現(xiàn)有民事法律關于習慣的規(guī)定,總結司法解釋中有關習慣的規(guī)定,總結學界有關民事習慣的論著,更需要認真進行民事習慣調(diào)查。
[Abstract]:The adoption and implementation of the General principles of Civil Law indicate that the compilation of the Civil Code in China is an important step forward. In order to understand the General principles of Civil Law, it is of positive significance to think about the scientific arrangement of custom in the compilation of Civil Code. It confirms the status of the formal legal source of the customary law. The General principles of Civil Law implicitly stipulate and absorb the custom, which reflects the respect for the endogenous norms of civil life in our country. At the same time, the General principles of the Civil Law still have a vacancy in the relevant habits. It is necessary to make up for and perfect the civil code when it is codified and when the civil code is completed as a whole. In the formulation of the civil code and the compilation of the civil code as a whole, it is necessary to sum up the customary provisions of the existing civil law. It is necessary to make a careful investigation of civil custom by summing up the regulations on custom in judicial interpretation and summing up the academic works on civil custom.
