論消費(fèi)者隱私權(quán)的法律保護(hù)

【摘要】:在科技尤其是電子、通訊和網(wǎng)絡(luò)技術(shù)迅猛發(fā)展的今天,侵犯消費(fèi)者隱私權(quán)的事件日益增多,消費(fèi)者私生活面臨的威脅和侵害愈加嚴(yán)重。毋庸置疑,保護(hù)消費(fèi)者隱私權(quán)是維護(hù)正常的社會(huì)再生產(chǎn)的需要,,也是保護(hù)公民權(quán)利的具體體現(xiàn)。在我國,法律沒有把隱私權(quán)確立為一項(xiàng)獨(dú)立的、主要的人格權(quán),只是借助司法解釋并通過保護(hù)名譽(yù)權(quán)的方式以維護(hù)公序良俗的隱私權(quán)是不完備、不周密的。本文從消費(fèi)者隱私權(quán)的基本概念入手,在分析國外隱私權(quán)的相關(guān)立法經(jīng)驗(yàn)基礎(chǔ)上,結(jié)合我國現(xiàn)行立法,提出我國消費(fèi)者隱私權(quán)法律保護(hù)的缺陷并提出完善我國消費(fèi)者隱私權(quán)的法律保護(hù)建議。本文分四個(gè)部分對(duì)消費(fèi)者隱私權(quán)的法律保護(hù)進(jìn)行了較為全面的闡述。 第一部分論述消費(fèi)者隱私權(quán)的概念、內(nèi)涵以及特征。消費(fèi)者隱私權(quán)包括知情權(quán)、選擇權(quán)、利用限制權(quán)、收益權(quán)和安全保障權(quán)五項(xiàng)內(nèi)容,呈現(xiàn)出主體特定化、客體擴(kuò)大化、財(cái)產(chǎn)價(jià)值更突出三大特點(diǎn)。 第二部分主要利用比較法,介紹美國、德國、日本、法國及其他國家隱私權(quán)法律保護(hù)的現(xiàn)狀。通過比較分析,域外啟示有三點(diǎn):一是在法律保護(hù)方式上我國應(yīng)采取直接保護(hù);二是在保護(hù)模式上我國必須有強(qiáng)制性的立法干預(yù);三是我國應(yīng)關(guān)注對(duì)網(wǎng)絡(luò)隱私的保護(hù)立法。 第三部分重點(diǎn)說明我國消費(fèi)者隱私權(quán)立法和司法保護(hù)現(xiàn)狀?偨Y(jié)當(dāng)前我國消費(fèi)者隱私權(quán)法律保護(hù)存在的問題主要表現(xiàn)在三個(gè)方面:一是消費(fèi)者隱私權(quán)保護(hù)立法滯后;二是消費(fèi)者隱私權(quán)保護(hù)司法欠缺;三是現(xiàn)有法律對(duì)消費(fèi)者隱私權(quán)的保護(hù)不能適應(yīng)經(jīng)濟(jì)及技術(shù)快速發(fā)展的要求。 第四部分是本文的重點(diǎn),針對(duì)我國消費(fèi)者隱私權(quán)保護(hù)存在的問題,分別從立法、司法、法制教育三個(gè)方面提出具體可行的完善我國消費(fèi)者隱私權(quán)法律保護(hù)制度的措施。立法上,在完善隱私權(quán)法律保護(hù)體系基礎(chǔ)上建立健全消費(fèi)者隱私權(quán)立法,包括在《消費(fèi)者權(quán)益保護(hù)法》中增加“消費(fèi)隱私權(quán)”制度、制定一部綜合性的《消費(fèi)者隱私權(quán)保護(hù)法》和制定《電腦個(gè)人數(shù)據(jù)保護(hù)法》保護(hù)消費(fèi)者網(wǎng)絡(luò)隱私權(quán);司法上,簡化小額消費(fèi)糾紛的訴訟程序、設(shè)置特別的消費(fèi)者保護(hù)法庭、建立有利于消費(fèi)者維權(quán)的訴訟費(fèi)用制度;法制教育上,通過各種方式加強(qiáng)對(duì)政府、經(jīng)營者、消費(fèi)者的法制宣傳與教育工作。
[Abstract]:With the rapid development of science and technology, especially electronic, communication and network technologies, the number of violations of consumers' privacy rights is increasing, and the threats and infringements on consumers' private lives are becoming more and more serious. There is no doubt that, Protecting consumer privacy is the need to maintain normal social reproduction, and it is also a concrete embodiment of the protection of civil rights. In our country, the law does not establish the right of privacy as an independent, primary personality right. It is not complete and thorough to maintain the public order and good custom privacy by means of judicial explanation and the way of protecting reputation right. This paper starts with the basic concept of consumer privacy, and analyzes the relevant legislative experience of foreign countries. Combined with the current legislation of our country, this paper puts forward the defects of the legal protection of consumer privacy in our country and puts forward some suggestions for perfecting the legal protection of the right to privacy of consumers in our country. This paper expounds the legal protection of the right to privacy of consumers in four parts. The first part discusses the concept, connotation and characteristics of consumer privacy. Consumer privacy includes the right to know, the right to choose, the right to use restrictions, the right to profit and the right to security protection. Property value more prominent three major characteristics. The second part mainly uses comparative law to introduce the current situation of the legal protection of privacy in the United States, Germany, Japan, France and other countries. Through comparative analysis, there are three points: first, our country should take direct protection in the way of legal protection; The second is that our country must have mandatory legislative intervention in the mode of protection, and the third is that our country should pay attention to the protection of network privacy legislation. The third part mainly explains the current situation of legislation and judicial protection of consumer privacy in China. It summarizes the problems existing in the legal protection of consumer privacy in our country: firstly, the legislation of consumer privacy protection lags behind; The second is the lack of judicial protection of consumer privacy, and the third is that the protection of consumer privacy by existing laws cannot meet the requirements of rapid economic and technological development. The fourth part is the focal point of this paper, aiming at the problems existing in the protection of consumer privacy in China, respectively from the legislative, judicial, Three aspects of legal education put forward concrete and feasible measures to improve the legal protection system of consumer privacy in China. In legislation, on the basis of perfecting the legal protection system of the right to privacy, we should establish and improve the legislation on consumer privacy. Including adding a "consumer privacy right" system to the Consumer Rights and interests Protection Law, formulating a comprehensive "Consumer Privacy Protection Law" and formulating the "computer personal data Protection Law" to protect consumer network privacy; judicially, To simplify the litigation procedures for small consumption disputes, to set up special consumer protection courts, and to establish a system of litigation expenses in favor of consumers' rights; and to strengthen legal education through various means to the government and operators, Consumer's legal publicity and education.
