【摘要】：當(dāng)前,社會(huì)經(jīng)濟(jì)快速發(fā)展,大眾傳媒的作用不斷地顯露出來(lái),人格權(quán)商品化現(xiàn)象已經(jīng)成為一種必然的趨勢(shì),特別是像姓名權(quán)或者是肖像權(quán)等這些標(biāo)表型人格權(quán)被商業(yè)化利用,制造經(jīng)濟(jì)利益的現(xiàn)象尤為明顯。但是由于市場(chǎng)經(jīng)濟(jì)的激烈競(jìng)爭(zhēng),侵害標(biāo)表型人格權(quán)的現(xiàn)象時(shí)有發(fā)生,而傳統(tǒng)的人格權(quán)制度認(rèn)為人格權(quán)不具有商業(yè)化的性質(zhì),這已經(jīng)難以滿足社會(huì)發(fā)展的需要。因此,我國(guó)應(yīng)該逐步完善對(duì)標(biāo)表型人格權(quán)的法律保護(hù)和救濟(jì)。本文將以標(biāo)表型人格權(quán)的基本理論作為出發(fā)點(diǎn),去論述我國(guó)關(guān)于標(biāo)表型人格權(quán)的立法現(xiàn)狀及存在的問(wèn)題,比較國(guó)外的立法,從中借鑒有益經(jīng)驗(yàn),以提出完善我國(guó)標(biāo)表型人格權(quán)的法律保護(hù)的建議。首先從積極行使權(quán)利的角度出發(fā),承認(rèn)標(biāo)表型人格權(quán),并明確其概念,擴(kuò)大標(biāo)表型人格權(quán)的主客體范圍,承認(rèn)它的轉(zhuǎn)讓性和繼承性,以對(duì)標(biāo)表型人格權(quán)被商業(yè)化利用的有關(guān)行為進(jìn)行有效地法律規(guī)制。同時(shí),從侵害標(biāo)表型人格權(quán)的角度出發(fā),確定侵犯標(biāo)表型人格權(quán)的認(rèn)定標(biāo)準(zhǔn)和救濟(jì)方式,以及明確規(guī)定標(biāo)表型人格權(quán)保護(hù)的限制等,以期我國(guó)對(duì)該法律制度規(guī)制的更加全面和具體。當(dāng)未來(lái)發(fā)生標(biāo)表型人格權(quán)在商業(yè)化的活動(dòng)過(guò)程中產(chǎn)生的法律糾紛時(shí)能夠得到有效地解決,保護(hù)權(quán)利主體的合法權(quán)益,使標(biāo)表型人格權(quán)免受非法的利用,同時(shí)也有利于法官裁判案件,有效地解決標(biāo)表型人格權(quán)帶來(lái)的新問(wèn)題,從而使社會(huì)得以穩(wěn)定、健康、有序發(fā)展。
[Abstract]:At present, with the rapid development of social economy, the role of mass media is constantly revealed. The commercialization of personality rights has become an inevitable trend, especially in the commercialization of personality rights such as the right to name or the right to portray. The phenomenon of creating economic benefits is particularly obvious. However, because of the fierce competition in the market economy, the phenomenon of infringing on the personality right of the phenotype occurs from time to time, while the traditional system of personality right thinks that the personality right does not have the nature of commercialization. This has been difficult to meet the needs of social development. Therefore, our country should gradually improve the legal protection and relief to the standard phenotypic personality right. This article will take the basic theory of the standard phenotype personality right as the starting point. To discuss the status quo and existing problems of the legislation of standard phenotypic personality right in our country, compare the legislation of foreign countries, and learn from the beneficial experience, In order to improve the legal protection of the right of phenotypic personality in China, the author first recognizes the right of phenotype personality from the angle of active exercise of the right, clarifies its concept, and expands the scope of subject and object of the right of phenotypic personality. Recognizing its transferability and inheritance, it can effectively regulate the behavior of commercial use of the personality right of the standard phenotypic personality. At the same time, from the angle of infringing the personality right of the standard phenotype, To determine the criteria for the identification and relief of the right to violate the phenotypic personality, as well as to specify the restrictions on the protection of the personality right of the phenotype, It is hoped that the legal system in China will be regulated more comprehensively and concretely. When the legal disputes arising from the commercialization of personality rights in the future can be effectively resolved, the legitimate rights and interests of the subject of rights can be protected. It can avoid the illegal use of the personality right of the standard phenotype, at the same time, it is helpful for the judge to adjudicate the case, effectively solve the new problem brought by the personality right of the standard phenotype, and make the society develop steadily, healthily and orderly.
