【摘要】:互聯(lián)網(wǎng)的迅猛發(fā)展使社會(huì)的政治、經(jīng)濟(jì)、文化、科技等領(lǐng)域發(fā)生了巨大的變化,在給人們生活帶來極大便利的同時(shí)也提出一系列新問題,如隱私權(quán)及其保護(hù),在傳統(tǒng)的現(xiàn)實(shí)世界尚未得到完善,而虛擬網(wǎng)絡(luò)世界使此問題更為突出、復(fù)雜。據(jù)調(diào)查顯示,截至2014年12月,我國(guó)共有6.49億網(wǎng)民,比2013年增加3117萬,其中19歲及以下的網(wǎng)民數(shù)量為1.59億,占整體網(wǎng)民數(shù)量的24.5%。成千上萬的未成年人進(jìn)入網(wǎng)絡(luò)世界,利用網(wǎng)絡(luò)搜索信息、學(xué)習(xí)課程、溝通聊天、娛樂游戲等。由于未成年人在判斷力、分辨力等方面的不成熟使其網(wǎng)絡(luò)隱私權(quán)保護(hù)更顯必要與緊迫。我國(guó)目前雖已有零散的法律法規(guī)保護(hù)網(wǎng)絡(luò)隱私權(quán),但針對(duì)未成年人這一特殊主體的保護(hù)范圍與力度仍不足。本文通過分析未成年人網(wǎng)絡(luò)隱私權(quán)的概念,透析未成年人網(wǎng)絡(luò)隱私權(quán)的獨(dú)特性,從國(guó)家立法、行業(yè)自律、監(jiān)護(hù)責(zé)任三個(gè)角度反思我國(guó)未成年人網(wǎng)絡(luò)隱私權(quán)保護(hù)現(xiàn)存問題及其原因,借鑒域外保護(hù)未成年人網(wǎng)絡(luò)隱私權(quán)的先進(jìn)模式,為推動(dòng)我國(guó)未成年人網(wǎng)絡(luò)隱私權(quán)的保護(hù)提出建設(shè)性意見。全文共分為四章。第一章為未成年人網(wǎng)絡(luò)隱私權(quán)概述,在明晰傳統(tǒng)隱私權(quán)概念及性質(zhì)的基礎(chǔ)上,論述了網(wǎng)絡(luò)隱私權(quán)的概念、內(nèi)容及與傳統(tǒng)隱私權(quán)的區(qū)別,從四個(gè)角度著重剖析未成年人網(wǎng)絡(luò)隱私權(quán)的特性:權(quán)利主體的特殊性、職責(zé)主體的多元性、侵權(quán)方式的多樣性、權(quán)利保護(hù)的艱難性。第二章分析我國(guó)未成年人網(wǎng)絡(luò)隱私權(quán)保護(hù)現(xiàn)存問題及其原因,在闡述我國(guó)目前有關(guān)保護(hù)未成年人網(wǎng)絡(luò)隱私權(quán)法律法規(guī)、互聯(lián)網(wǎng)行業(yè)自律機(jī)制的基礎(chǔ)上,分析了當(dāng)前我國(guó)保護(hù)措施中存在的問題:立法缺陷導(dǎo)致依據(jù)不足、互聯(lián)網(wǎng)行業(yè)自律機(jī)制不到位、監(jiān)護(hù)人的監(jiān)護(hù)責(zé)任缺位,在此基礎(chǔ)上解讀問題存在的原因。第三章探析域外未成年人網(wǎng)絡(luò)隱私權(quán)保護(hù)先進(jìn)模式,主要介紹了域外兩種較為典型的網(wǎng)絡(luò)隱私權(quán)的保護(hù)模式,即以美國(guó)為代表的行業(yè)自律模式、以歐盟及日本為代表的立法模式,分析了兩種模式各自的優(yōu)勢(shì)與不足以及對(duì)我國(guó)的借鑒與啟示。第四章提出完善我國(guó)未成年人網(wǎng)絡(luò)隱私權(quán)保護(hù)的措施與路徑。本章是本文的重點(diǎn)內(nèi)容,對(duì)未成年人網(wǎng)絡(luò)隱私權(quán)的保護(hù)應(yīng)圍繞三方主體責(zé)任進(jìn)行:政府、行業(yè)、公民。政府的責(zé)任在于明晰立法精神、完善法律體系;行業(yè)的責(zé)任在于提高行業(yè)自律程度、完善監(jiān)督與投訴機(jī)制;公民的責(zé)任在于教師與監(jiān)護(hù)人雙方共同努力保護(hù)未成年人的權(quán)利。
[Abstract]:With the rapid development of the Internet, great changes have taken place in the fields of politics, economy, culture, science and technology, which not only bring great convenience to people's life, but also raise a series of new problems, such as the right to privacy and its protection. The traditional real world is not yet perfect, but the virtual internet world makes the problem more serious and complex. As of December 2014, there were 649 million Internet users in China, an increase of 31.17 million from 2013, according to a survey. Of these, the number of Internet users aged 19 and below is 159 million, accounting for 24.5% of the total number of Internet users. Thousands of minors enter the Internet world, use the Internet to search information, study courses, communicate and chat, play games, etc. As a result of minors' judgment, The immaturity of discrimination makes the protection of network privacy more necessary and urgent. Although there are scattered laws and regulations to protect network privacy in China, However, the scope and strength of the protection of minors as a special subject are still insufficient. This paper analyzes the concept of minors' network privacy, analyzes the uniqueness of minors' network privacy, and analyzes the national legislation and industry self-discipline. From three angles of guardianship responsibility, this paper reflects on the existing problems and causes of the protection of minors' network privacy in our country, and draws lessons from the advanced mode of overseas protection of minors' network privacy. In order to promote the protection of minors' network privacy in China, the paper is divided into four chapters. The first chapter is an overview of minors' network privacy, on the basis of clarifying the concept and nature of traditional privacy. This paper discusses the concept, content and difference between the network privacy and the traditional privacy, and analyzes the characteristics of the minors' network privacy from four angles: the particularity of the right subject, the diversity of the duty subject, the diversity of the infringing way, the special nature of the network privacy right of the minor. The second chapter analyzes the existing problems and causes of the protection of minors' network privacy in our country. On the basis of expounding the current laws and regulations on the protection of minors' network privacy, and the self-discipline mechanism of the Internet industry, This paper analyzes the problems existing in the current protection measures of our country, such as the deficiency of legislation, the lack of self-discipline mechanism in the Internet industry, the absence of guardianship responsibility, The third chapter analyzes the advanced mode of network privacy protection for minors, mainly introduces two typical overseas network privacy protection models. That is, the industry self-discipline model represented by the United States, and the legislative model represented by the European Union and Japan. This paper analyzes the advantages and disadvantages of the two models and their reference and enlightenment to our country. The fourth chapter puts forward the measures and ways to improve the protection of minors' right to privacy on the Internet. This chapter is the key content of this paper. The protection of minors' right to network privacy should revolve around the responsibility of three parties: government, industry and citizen. The responsibility of government lies in clarifying the legislative spirit and perfecting the legal system, and the responsibility of the industry lies in improving the degree of self-discipline of the industry. The responsibility of citizens lies in the joint efforts of teachers and guardians to protect the rights of minors.
