論一房二賣中合同解除后的責(zé)任承擔(dān)

【摘要】:近年來,我國社會經(jīng)濟(jì)迅速發(fā)展,房產(chǎn)交易也愈加繁榮,伴隨著產(chǎn)生了大量有關(guān)“一房二賣”的法律糾紛。在“何X帥與綿陽市XX房地產(chǎn)開發(fā)有限公司關(guān)于商品房買賣合同糾紛”一案中,申請人何X帥與被申請人綿陽市XX房地產(chǎn)開發(fā)有限公司簽訂了商品房買賣合同,何X帥采取“借款抵房款”的方式,支付了購房款;之后,被申請人未向申請人交付合同約定的房屋,而將房屋出售給了第三人楊X霖,并為其辦理了商品房預(yù)售合同登記備案。雙方圍繞申請人是否支付了購房款、申請人是否還有取得房屋的可能性以及被申請人是否應(yīng)當(dāng)承擔(dān)懲罰性賠償責(zé)任發(fā)生爭議。根據(jù)我國法律的相關(guān)規(guī)定、司法實(shí)務(wù)中的審判實(shí)例及法學(xué)界的相關(guān)理論,通過分析“借款抵房款”的購房款支付效力、商品房預(yù)售合同登記備案的法律效力,筆者認(rèn)為何X帥已經(jīng)支付了購房款,其沒有取得房屋的可能性,可以要求與被申請人解除房屋買賣合同,并要求被申請人承擔(dān)懲罰性賠償責(zé)任。
[Abstract]:In recent years, with the rapid development of China's social economy, real estate transactions have become more prosperous. With the emergence of a large number of legal disputes related to "one house and two sales". In the case of "he X Shuai and Mianyang XX Real Estate Development Co., Ltd., concerning the contract dispute over the sale of commercial housing", The applicant he X Shuai and the respondent Mianyang XX Real Estate Development Co., Ltd. signed a contract for the sale of commercial housing. He X Shuai took the method of "borrowing money to pay for the house" and paid for the purchase of the house. Instead of delivering the houses agreed upon in the contract to the applicant, the respondent sold the house to Yang Xilin, a third party, and registered the contract for the pre-sale of commercial housing for the applicant. Whether the applicant still has the possibility of acquiring the house and whether the respondent should bear the punitive damages liability is controversial. According to the relevant provisions of Chinese law, the trial examples in the judicial practice and the relevant theories in the field of law, Through the analysis of the payment effect of the purchase of "loan against the house" and the legal effect of the registration and record of the commercial housing pre-sale contract, the author thinks that he X has already paid the purchase money, and that he has not obtained the possibility of housing. We can ask for rescission of the contract of sale and purchase of the house with the respondent, and ask the defendant to bear the punitive liability.
