【摘要】：法律問題是困擾檔案館等機(jī)構(gòu)口述資料收藏的主要法律瓶頸,其中著作權(quán)的權(quán)利歸屬和移轉(zhuǎn)是核心。從收集、整理到提供利用的整個(gè)過程中所涉及的主要法律關(guān)系有訪談員與被訪者、檔案館與口述歷史項(xiàng)目組、檔案館與資料的利用者。所適用的法律則主要包括《著作權(quán)法》、《著作權(quán)法實(shí)施條例》、《信息網(wǎng)絡(luò)傳播權(quán)保護(hù)條例》、《關(guān)于審理著作權(quán)民事糾紛案件適用法律若干問題的解釋》以及《檔案法》和《檔案法實(shí)施辦法》等,而《民法》中的"意思自治"則賦予了雙方自由協(xié)商和公平約定的權(quán)利。
[Abstract]:Legal problems are the main legal bottleneck that puzzles the oral data collection of archives and other institutions, in which the ownership and transfer of copyright rights are the core. The main legal relationships involved in the whole process of providing access include interviewers and interviewees, archives and oral history project teams, The applicable laws mainly include the copyright Law, the regulations on the implementation of the copyright Law, the regulations on the Protection of the right of Information dissemination on the Internet, and some issues concerning the Application of the Law in handling cases of copyright Civil disputes. As well as the interpretation of the Archives Law and the implementation measures of the Archives Law, The autonomy of will in the Civil Law gives both sides the right to negotiate freely and agree fairly.
