【摘要】：從我國人體基因資源保護(hù)的相關(guān)立法來看,主要缺陷包括對人體基因法律屬性定位不明確、缺乏足夠調(diào)整規(guī)范和具體保護(hù)范圍等。在明確人體基因兼具人格和財產(chǎn)這一復(fù)合屬性的基礎(chǔ)上,從私法和公法的雙重角度思考構(gòu)建我國人體基因資源的立法保護(hù)模式。私法保護(hù)主要通過人體基因權(quán)利體系的建構(gòu)與權(quán)利損害救濟機制的設(shè)置來加以實現(xiàn);公法保護(hù)則采用國家公權(quán)力的主動干預(yù)模式,通過防止人體基因資源過度開發(fā)以及基因技術(shù)對人體基因資源的濫用來實現(xiàn)有效保護(hù)。
[Abstract]:Judging from the relevant legislation on the protection of human genetic resources in China, the main defects include unclear positioning of the legal attributes of human genes. Lack of adequate regulation and specific scope of protection, etc. On the basis of defining the complex attributes of both personality and property in human genes, From the dual angle of private law and public law, the legislative protection mode of human genetic resources is constructed. The protection of private law is mainly realized through the construction of the system of human genetic rights and the establishment of relief mechanism for the damage of human body. On the other hand, public law protection adopts the active intervention mode of the state public power, and realizes the effective protection by preventing the overexploitation of human genetic resources and the misuse of human genetic resources by genetic technology.
