【摘要】：為了保護(hù)馳名商標(biāo)的商譽(yù),維護(hù)馳名商標(biāo)權(quán)利人的利益,目前,我國已通過《商標(biāo)法》及相關(guān)司法解釋、行政法規(guī)確立了馳名商標(biāo)反淡化制度,為馳名商標(biāo)提供擴(kuò)大保護(hù)。但是,馳名商標(biāo)權(quán)利范圍的不當(dāng)擴(kuò)張以及反淡化保護(hù)的濫用將會導(dǎo)致侵犯公民言論自由、侵害其他經(jīng)營者使用標(biāo)識權(quán)利、擾亂競爭秩序等問題,因此,在給予馳名商標(biāo)權(quán)利人合理的擴(kuò)大保護(hù)前提下,我國應(yīng)當(dāng)明確確立馳名商標(biāo)反淡化保護(hù)的限制制度,確保馳名商標(biāo)權(quán)利人正當(dāng)行使權(quán)利,維護(hù)正常的市場競爭秩序。本文以馳名商標(biāo)反淡化保護(hù)的限制為研究對象,介紹了淡化與反淡化保護(hù)的基本理論,從理論和實踐兩個方面探討了馳名商標(biāo)反淡化保護(hù)限制的合理性與現(xiàn)實狀況,并分析、提煉出反淡化保護(hù)限制的考慮因素,總結(jié)了反淡化保護(hù)限制制度的完善。本文第一章介紹了淡化與反淡化保護(hù)的基本理論,闡述了商標(biāo)淡化的起源、發(fā)展、涵義、構(gòu)成要素與類型,以及反淡化保護(hù)的涵義、制度沿革和制度價值,力圖從多方面對商標(biāo)淡化與反淡化保護(hù)進(jìn)行梳理,為反淡化保護(hù)限制的分析提供基礎(chǔ)。第二章從理論上對反淡化保護(hù)的限制做出了解讀,分析了給予馳名商標(biāo)擴(kuò)大保護(hù)的合理性,闡釋了防止馳名商標(biāo)權(quán)利人濫用權(quán)利的必要性,以及反淡化保護(hù)限制在維護(hù)正常的市場競爭秩序、保護(hù)消費者利益方面的益處。第三章從現(xiàn)行立法、司法保護(hù)、行政保護(hù)三個方面分析了我國反淡化保護(hù)限制的現(xiàn)狀。筆者以我國現(xiàn)行的反淡化保護(hù)相關(guān)立法為依據(jù),對我國是否引入了反淡化保護(hù),以及現(xiàn)行立法對反淡化保護(hù)的限制性規(guī)定等問題作出了分析。同時,筆者收集了大量較新的相關(guān)案例,通過對判決的比較與分析,提出了司法實踐中反淡化保護(hù)標(biāo)準(zhǔn)不一,相當(dāng)一部分法官尚未完全理解淡化理論,不清楚反淡化保護(hù)的適用條件等亟待解決的現(xiàn)實問題,并具體闡釋了相關(guān)的司法政策、裁判規(guī)則以及限制因素。在上述理論闡釋與實踐分析的基礎(chǔ)上,筆者在第四章中提出了反淡化保護(hù)限制的考慮因素,并從比較法的角度,論述了顯著性、知名度、馳名商標(biāo)與在后商標(biāo)的相關(guān)公眾關(guān)系、他人已在欲跨類別上注冊與馳名商標(biāo)相同的商標(biāo)等因素與反淡化保護(hù)的關(guān)系。第五章提出了完善反淡化保護(hù)限制制度的具體建議。筆者認(rèn)為,考慮到我國的現(xiàn)實情況,對《商標(biāo)法》和《商標(biāo)法實施條例》進(jìn)行相應(yīng)的修改,并出臺配套的司法解釋和行政法規(guī),是現(xiàn)階段完善我國反淡化保護(hù)限制制度最為可行的方案。
[Abstract]:In order to protect the goodwill of well-known trademark and protect the interests of the owner of well-known trademark, at present, China has established the system of anti-desalination of well-known trademark through "Trademark Law" and related judicial interpretation. However, the improper expansion of the scope of well-known trademark rights and the abuse of anti-dilution protection will lead to infringement of citizens' freedom of speech, infringement of other operators' right to use marks, and disturbance of competition order. Therefore, on the premise of extending the protection to the owner of well-known trademark, our country should clearly establish the restriction system of anti-desalination protection of well-known trademark, and ensure that the owner of well-known trademark can exercise his right properly. This paper takes the limitation of well-known trademark anti-desalination protection as the research object, and introduces the basic theory of desalination and anti-desalination protection. This paper probes into the rationality and reality of the protection limit of well-known trademark anti-desalination from two aspects of theory and practice, and analyses the factors considered in anti-desalination protection limitation. The first chapter introduces the basic theory of anti-desalination and anti-desalination protection, expounds the origin, development, meaning, elements and types of trademark desalination, as well as the meaning of anti-desalination protection. The evolution of the system and the value of the system try to comb trademark dilution and anti-dilution protection from many aspects, and provide the basis for the analysis of anti-desalination protection restrictions. Chapter two explains the limits of anti-desalination protection theoretically. This paper analyzes on the rationality of extending the protection of well-known trademarks, expounds the necessity of preventing the abuse of rights by the owners of well-known trademarks, and the restriction of anti-desalination protection in the maintenance of normal market competition order. The third chapter analyzes the current situation of anti-desalination protection in China from three aspects: current legislation, judicial protection and administrative protection. This paper analyzes whether anti-desalination protection has been introduced into our country and the restrictive provisions of anti-desalination protection in current legislation. At the same time, the author has collected a large number of relatively new relevant cases, and through the comparison and analysis of the judgment, This paper points out that the standards of anti-desalination protection are different in judicial practice, that quite a few judges have not fully understood the desalination theory, and that the applicable conditions of anti-desalination protection need to be solved urgently, and that the relevant judicial policies are explained concretely. On the basis of the above theoretical explanation and practical analysis, the author puts forward the considerations of anti-desalination protection restriction in the fourth chapter, and discusses the significance and popularity from the perspective of comparative law. The public relations between well-known trademarks and post-trademark, Others have tried to register the same trademark as well-known trademark across categories and the relationship between anti-dilution protection and anti-desalination protection. Chapter five puts forward specific suggestions on how to improve the anti-dilution protection restriction system. To amend the Trademark Law and the implementing regulations of Trademark Law, and to introduce the corresponding judicial interpretation and administrative regulations, is the most feasible scheme to perfect the protection and restriction system of anti-desalination in our country at this stage.
